The Issue

We, the undersigned, are concerned veterans of the United States Armed Forces, family members, friends, and their supporters, who hereby petition to address a critical issue affecting our nation’s heroes. We are deeply concerned about the Department of  Veterans Affairs' (VA) actions that may infringe upon the Second Amendment rights of veterans based on their healthcare status and disabilities.

Background:

The Second Amendment of the United States Constitution guarantees the right to keep and bear arms. This individual fundamental right is a cornerstone of American freedom and democracy. Veterans, who have bravely served and sacrificed for our country, should not face the loss of this constitutional right due to their engagement with VA healthcare services.

Issue:

It has come to our attention that the VA is continuing or attempted in taking away the Second Amendment rights of veterans. This has been done through the reporting of veterans to the National Instant Criminal Background Check System (NICS) based on their health conditions or the appointment of fiduciaries to manage their benefits, without due process and thorough assessment. In many times these actions are taken out of reprisal by VA employees.

Concerns:

Lack of Due Process: Veterans are being reported to NICS without a proper judicial process, violating their constitutional rights.
Stigmatization: Many veterans seek help for mental health issues or other medical conditions, and the fear of losing their Second Amendment rights may deter them from seeking the necessary care.
Overreach: The broad and sometimes arbitrary criteria used to determine a veteran’s competency regarding their Second Amendment rights can lead to unjust outcomes. The VA officials are able to do this unilaterally with little oversight. 
Veteran Trust: Actions that undermine veterans' rights can erode their trust in the VA, negatively impacting their willingness to seek medical assistance and support.

These actions are a bureaucratic system in which the veteran has little knowledge, no input, and no ability to challenge. The Supreme Court of the United States has long decided and affirmed that only a court of law can deny someone their individual civil rights. 


Petition:

We respectfully urge the President, Congress, and the Department of Veterans Affairs to:

Implement Due Process Protections: Ensure that any decision to report a veteran to NICS involves a fair and transparent judicial process, including the opportunity for the veteran to contest the decision before a federal judge or magistrate independent of the Department of Veterans Affairs.
Review and Revise Criteria: Reevaluate the criteria used to determine a veteran’s competency concerning their Second Amendment rights, ensuring they are just, clear, and not overly broad.
Increase Transparency: Provide veterans with clear information about how their healthcare decisions and the appointment of fiduciaries may impact their Second Amendment rights.
Protect Privacy: Safeguard the privacy of veterans’ medical records and ensure that only necessary and relevant information is considered in any decision that might affect their constitutional rights.
Support and Resources: Offer resources and legal assistance to veterans who wish to contest decisions affecting their Second Amendment rights at government expense.
Educate VA Staff: Train VA staff on the importance of protecting veterans' constitutional rights and the proper procedures for addressing concerns about a veteran's competency.
By taking these actions, we can ensure that the rights of those who have defended our freedoms are themselves protected. Veterans should be honored and supported, not subjected to unjust restrictions on their constitutional rights.

We urge immediate action to protect the Second Amendment rights of all veterans receiving VA healthcare.
