Declare breaking the window of a hot car to save a child or dog legal, provided appropriate action has been taken to find the parent/owner.

The Issue

Every year, every summer, we read stories about dogs dying in hot cars because someone thought it would be absolutely fine to leave him/her on the back seat with all the windows closed during the middle of the day at the hottest time of the year. 

Due to the levels of cutbacks the various police services across the UK have had to endure the public have had to rely more and more on their fellow civilians in order to help each other. When it becomes obvious that the police response time will not be quick enough to save a life we, the petitioned, ask you to make it a legal action to break/remove the window of the vehicle without repercussion provided appropriate action has been taken to find the owner and the police have been notified.

The current guidelines state that:

'at the time of the act or acts alleged to constitute the offence you believed that the person or persons whom you believe to be entitled to consent to the destruction of or damage to the property in question . . . .would so consent to it if s/he . . . had known of the destruction or damage and its circumstances' (section 5(2)(a) Criminal Damage Act 1971).'

Essentially, the law says that whoever it is who's car you're breaking in to would have to say that they would have agreed to you doing so if they had been there to avoid you going to court. I'm sorry, but nobody who possessed such lack of compassion to leave their child or pet in a car as it slowly cooked them alive is going to think twice about taking somebody to court for breaking their window. This is unfair, unjust and is promoting complacency amongst members of the public who would otherwise have stepped in to do the right thing.
