Stop School Bullying and Protect Students' Privacy
The Issue
My son, a 5th grader a Curtis Fundamental Elementary School in Dunedin, Florida, is the victim of school bullying. Additionally, his privacy and his fundamental right to privacy has been violated by the school. The bully is his fifth-grade teacher.
While it was ongoing for months, his teacher's bullying reached a crescendo on December 9 when she publicly and repeatedly mocked him over an issue she had been warned not to discuss with him. At this point, she instructed the entire class not to communicate with my son in any manner. Embarrassed and nowhere to hide, my son attempted to bury his head and his tears as deep into the top of his desk as he possibly could. When he became unresponsive and unable to concentrate on his work, his teacher took out her phone to digitally capture my son not completing his classwork. The class was told they could view the photographs later. When the bullying was over, my son was sent to the Principal's office, which was told he was sent there because he wasn't doing his classwork.
In addition to repeated bullying, this teacher further violated my son's federally protected rights by ignoring the terms of his 504 plan.
Attempts to discuss this issue with the Area Superintendent of Pinellas County Schools, the Superintendent of Pinellas County Schools, and every member of the Pinellas County School Board have been ignored.
To date, there have been no actual consequences for a teacher bully my son or for the school fundamentally violating his right to privacy.
Please help compel Curtis Fundamental Elementary School to stop school bullying and protected the privacy rights of students by getting them to do the following:
--Prove that any photographs, video, or other types of digital images of my son taken by his teacher have been deleted, including removal from physical or Cloud-based backup systems.
--Assure any physical copies of photographs of my son taken by his teacher have been destroyed.
--Assure that any photographs, video, or other types of digital images of my son by his teacher and distributed to other parties, electronically or otherwise, have been deleted, including on physical or Cloud-based backup systems.
--Have this teacher immediately placed on administrative leave until proper anti-bullying and student privacy training has been satisfactorily completed.
