Update!!! Due to this injustice, he not only missed our daughter's life, He also missed the births of our granddaughter and grandson and not scheduled to be released from his wrongful conviction until our 3 year old granddaughter is almost 17 years old..

I have watched my life pass me by as I have fought tirelessly for Marchello's freedom for the last 23 years alone, only to never see his life returned to him and he come home to his family...
In 2001 Marchello Jackson was just 19 years old when he became a father. Two months after the birth of our daughter, Marchello was wrongfully arrested, and he was 20 years old by the time he was wrongfully convicted and sent to prison to never return to his baby daughter and family again...
This injustice has caused Marchello to miss our daughter's whole life from kindergarten graduation all the way up to college graduation. Marchello didn't deserve to have his life snatched from him before it even started and neither did our daughter deserve to grow up fatherless due to this injustice...
That 9 month old little girl had to visit her father through a several inch thick glass. She would jump at the glass with attempts to try to jump into her father's arms, only to be blocked by the glass. At 20 years old she was expecting her first child. It hit Marchello hard. Marchello already missed our daughter's life, but now as a result of injustice, he is about to miss the next generation as well. I currently take our grandchildren to visitations on the weekend, we are now grandparenting through the same bars we raised our daughter through...

There is more evidence that says Marchello didn't commit the crime he's accused of, and in fact the evidence actually points to the alleged crime never even happening at all. So Marchello Jackson is locked away for generations for something, not only he didn't do, but also for something that never even happened...
Marchello was basically a baby himself when he was thrown away and sentenced to 40 years in Florida Department of Corrections. For the last 23 years, I have taken our daughter to visit her dad in prison. It was very costly to travel all over the state of Florida for the last 23 years. He missed her whole life growing up. 2019 she graduated from tech school (on the National Honor Society) and high school (on the National Honor Society) as a dual enrollment student. 2020 she was in college on a full ride scholarship studying forensic science. She is currently a mother of two and a nursing student...
He wasn't there for her first words to her high school graduation. HER SENIOR YEAR, IN 2019, I ATTENDED SEVERAL AWARD CEREMONIES FOR OUR DAUGHTER ALONE. He missed it all. All I could do was email him a picture of her big day graduating. Even if they let him go today, they still could not replace what they stole from us. Then due to this whole ordeal, I was forced to raise our daughter alone. While doing so I worked some times two and three jobs at a time to supplement my husband Marchello being gone. 2016, I returned to college and received my degree in graphic design. My daughter and I attended college together at the same time, at the same school. (PLEASE HELP MAKE SURE HE IS HOME FOR BOTH OF OUR GRADUATIONS NEXT YEAR!!!)
That was my plea when I first wrote this petition in 2020, but because I wasn't able to get the petition big over the last 5 years, he missed my and her graduations..
May 2022 Baby girl was scheduled to graduate and give birth to our grand daughter the same month, he missed those mile stones as well...
Marchello Jackson was wrongfully convicted In the state of Florida and excessively sentenced without any evidence against him. None of his fingerprints, no DNA, no GSR testing that matched him were ever recovered. There was no tangible evidence at all that linked Marchello to this alleged crime ever recovered. Though Marchello's state appointed public defender knew that Marchello Jackson was being railroaded through the system, the public defender put up no fight for Mr. Jackson’s life. In fact Marchello Jackson's state appointed lawyer is an intricate reason Marchello was convicted. You heard me right, his own lawyer ensured that Marchello was wrongfully convicted. The lawyer refuse to fight, saying no, he cannot do this and that, to every thing that Jackson said could prove his innocence...
The state appointed attorney actually worked against Marchello. It was bad enough that he put up no fight for Marchello, but in fact, all the public defender did do, was try to coerce Marchello into taking a 17 year plea bargain, and try to detour Marchello from his right to a fair trial. Marchello wanted to fight for his innocence by taking his case to trial, he stated, "I can not take 17 years for a crime I did not commit!" Marchello asked his public defender if they could pull surveillance at the 7-Eleven he was at so Marchello could prove his whereabouts, his public defender said no because that costs too much money and his firm doesn't have that much money, and his firm does not have that type of resources. Marchello then asked his public defender if he could pull the surveillance at the club/hotel (the alleged crime scene) to prove he wasn’t there. The club was the alleged scene that the alleged robbery took place. The public defender lied and said "No cameras can't be pulled because the club doesn’t have surveillance cameras outside." Which we found that to be a lie, because in a news article a few years later, there was another robbery in the same parking lot of the club/hotel Marchello was accused of robbing someone in. In that article it stated that the police found the robbery suspect by pulling the surveillance cameras in the parking lot of the club/hotel. Why did they lie and say there were no cameras???
Because the surveillance cameras would have actually proved Marchello's story of never even being in the club's parking lot...
It was Sunday night and I have driven past that club/hotel on Sundays, usually there are people in cars and in the parking lot, but during testimony, the victim/witnesses say no one was outside and the parking lot was empty except for them in the car??? That too was a lie because Sunday night was a big night for that club/hotel, they had a famous dance that was scheduled to start at Midnight the day in question. Which means the night of the alleged crime, the parking lot couldn't have been empty, most likely, it would have been full from the patrons pulling in the parking lot to attend the event. They said that to make it seem like there were no witnesses around so you would have to take their word for it.
Marchello was never given the chance to prove his whereabouts. That was taken from him and could have proven that he couldn't have committed a robbery in the parking lot because he in fact was never there.
They scheduled trial and no one but Marchello showed up. The victim/witnesses and no one else on the opposing side showed up to trial when it was scheduled. The two victim/witnesses were subpoenaed to be questioned and to come to court 3 times each. Which is a total of 6 subpeonas that were sent out for the victim/witnesses to come testify about the night they were allegedly robbed. Instead of coming to court both victims/witnesses moved to two different cities in Vermont outside of Florida and didn't show up to the original trial date and didn’t want to be bothered...
It is my belief after spending over two decades researching this case, that the two victims/witnesses were being forced to lie and testify against Marchello. Because no one showed up to court to press charges against Marchello Jackson, they were supposed to let him go. Instead to letting him go, the judge decided to continue the case against Marchello at Marchello's public defender's request. Since the victims/witnesses did not show up to court, we asked Marchello's public defender what does that mean. He said that means, if the victims/witnesses don’t show up again to the rescheduled continued trial date, all charges against Marchello would have to be dropped. That's when his public defender informed us that both victims/witnesses moved to two different cities in another state and didn’t want to be bothered, but he’s (Marchello's lawyer) is going to go out of town and see if he can subpoena them in person to come to court to testify against his client???
Marchello's public defender then petitioned the court for money for travel and lodging to go to a totally different state to subpeona (force in person) the victims/witnesses in person to come to court to testify against his own client. (But why didn't he do the same thing and petition the court for money to pull those surveillance cameras his firm couldn't afford??? They were basically forced to come to court against their will and if it wasn't for Marchello's own public defender, Marchello would have been set free.. Marchello's defense lawyer was clearly working against him...
"This case against Marchello Jackson was based entirely on shaky circumstantial evidence and the word of two witnesses that admit on the stand to drinking the night in question and then quickly sobering up to give account of what happened. When the witnesses did testify, they had conflicting stories on everything.
The money victim/witnesses said Marchello robbed from them did not add up. In the victims/witnesses written affidavits to the police they wrote that Marchello robbed $80 from them. Once the police checked Marchello and found he only had $60 on him, he gave the victims/witnesses their written affidavits back and told them to cross out $80 and write in $60 so that the amounts could line up. Also the arresting officer in Marchello's case had a different case against him. The following is an exerpt from an article about the arresting officer.
[The mother of a man who was shot and killed by Orlando police after police said he robbed a store, tried to carjack a woman and then ran from officers, has filed suit against the city. Defendants include the city of Orlando and five officers: Anthony Miller, who has since retired from the Orlando Police Department, Edward Michaels, Jeff Rine, Rob Costa and Jason Sauvage...But Jerry Girley, Jackson's lawyer, said there is "Substantial Disharmony" about the officers' accounts. But he acknowledges officers had reason to confront Cliatt. One of the issues, Girley said, is that 51 shots were fired...The suit accuses the officers of battery through excessive force, wrongful loss of Cliatt's life, violating his rights, and physical pain, suffering and emotional trauma. An OPD spokeswoman could not comment on the lawsuit.]

The same is true in Marchello's case there were three officers there the night in question the arresting officer being one of the same ones from the above wrongful loss of life story above. All three officers had different accounts of what happened that night and we're disharmonious
Also that same arresting officer changed the setting of the alleged crime from the initial police report to his testimony during trial, and he lied and said he seen Marchello come out the parking lot of the club/hotel, but it was impossible for that to be true because where the officer said he was when he observed Marchello allegedly exit the club/hotel parking lot. He couldn't see the parking lot not only because it was too far away to see, but also because the street vears over and trees obstruct the view even if he could see that very long distance. If that wasn't enough, it was also at night...
Either he was super human or he lied???
During the trial the victims/witnesses were asked why they wrote $80 then crossed it out and then wrote $60. One of the victims/witnesses claimed that was because they were so shaken up that they meant $60, but wrote $80. The judge said that you cannot charge Marchello Jackson with robbery, because the money does not add up to the amounts that the victim/witnesses say it was that was taken from them. It’s not the amount that Marchello was found and arrested with, so it doesn’t make sense as to where the rest of money is. The judge got loud when he was talking about this issue. Marchello was picked up with $60 in his pocket and he said he had just got paid from work that day. In which the DA was asked during trial why they failed to verify whether Marchello was, or was not working. The DA also was asked why they failed to have the victims/witnesses wallets dusted for Marchello Jackson's finger prints, they claimed Marchello demanded the victims/witnesses wallets and searched through them each before throwing them down. If that was in fact the truth, Marchello's fingerprints would definitely turn up, but the state failed to do that. The judge said the money doesn't add up, so you can’t charge Marchello with robbery! So the Judge dropped those two counts of strong armed robbery. That's when the state's lawyer said "Well he tried to rob them, he tried!" The judge then allowed the charges to be picked back up as attempted robbery. During this one alleged crime act, the state brought forth against Marchello Jackson six total charges.
The only defense Marchello‘s public defender put up was, when one of the witnesses/victims wrote their statement, they ended the statement with a smiley face and who that was just robbed and taken from their destination would end their statements with drawing a smiley face. All the other things he could have presented, that's all he based his defense on??? He never even prepared a defense at all for Marchello. Also NO GUN (the alleged crime weapon) was ever recovered, so Marchello is convicted of having a non existant weapon.
It was said that two people committed the alleged robbery. Why was the second perpetrator said to have not been caught and the whole ordeal fell on Marchello Jackson being the master mind? They claimed that the second perpetrator was able to get away from the perimeter the police set up, they were able to dodge the dogs they sent after them and the helicopter, now does that seem like the truth???
After trial the jury then deliberated, it was a very short deliberation, less that an hour. How did the jury get through ten pages of jury instructions and make a sound decision in less that an hour. During the deliberation process, the jury came back with questions about the case. (The jury was made of an all white jury except one black man, the alternative juror was also white). The judge said that he was not going to answer one of the jury’s questions. And the other questions that the jury asked if they could get two copies of the transcripts to go over a couple things. The judge said tell them they would have to come back the next day, then per the transcripts, the judge stated, "That'll fix that". I guess the jury did not want to come back the next day. It's even in the transcript where a jury member is asking how long would this all take. That is when the jury came back with a guilty verdict on all charges brought forth on Marchello Jackson in the highest. (The jury was also instructed that they could convict Marchello without the gun enhancement because there was no gun recovered.) That means the jury closed the case with questions they had no answers to. That is making a decision with reasonable doubt.
A jury is not supposed to come to a conclusion of guilty if there is reasonable doubt, this case is filled with reasonable doubt...The judge then used his own biased discretion and unjust practices to hand down the harsh sentence that Marchello Jackson received.
There was no recovery of the alleged weapon used the night in question, though the weapon is what is holding so much weight in Marchello Jackson's case. The injustice then continued when Marchello Jackson was sentenced under the Florida’s 10-20-life sentencing statue. This statue was for cases that a gun was used. Marchello was charged under 10-20-life, but no gun was ever recovered in Marchello's case. This statue came on the tail end of Florida's tough on crime laws that were being enacted in the late 1990's by Governor Jeb Bush. In 2016 Governor Rick Scott ruled that 10-20-life sentencing statue was unjust and it was overturned, but not set to be retroactive. Though they admit that because of the statue many young minorities that probably should have gotten a second chance did not, and it is said that 10-20-life is also a direct effect to Florida's mass incarceration problem.
Rick Scott said the decision to overturn this bad unjust law is, because it took the discretion out of the judges hands and people were sentenced under one blanket decision. The judge was not allowed to apply their own discretion to the cases. However in the case of Marchello Jackson the judge was able to apply his own discretion, because he sentenced Marchello to four times the amount of time that was set according to the 10-20-life sentencing guidelines. Four times the amount that in 2016 was referred to as being unjust. I, in my heart believe that the judge was making an example out of Marchello. Shortly after the judge sentenced Marchello, he moved up from circuit court judge to supreme court judge. I always wondered how many other people the judge sentenced like this. The judge then served as supreme court judge since 2004.
When I met with Marchello‘s lawyer after his sentencing date, the lawyer served me a paper. He said "Here this is something that also played a part in Marchello getting convicted." It was a written statement from someone that Marchello asked to be subpoenaed to court to testify. Marchello's public defender said "No she can not be subpoenaed to court to testify because she was not a credible witness." But the same girl was credible enough to give a written statement. How does that make sense. That written statement was not presented during trial. The girl in the statement said she was with Marchello the entire time leading up to the time the alleged robbery took place. That was a complete lie because Marchello Jackson spent the entire day leading up to right before the time in question with me. Why wasn't I able to testify about his where abouts??? In the written statement the girl was said she was with Marchello the time leading up to the crime and she braided Marchello's dreads down. She said as she braided his dreads Marchello told her how he was going to rob someone. That is also a lie because Marchello spent the entire day leading right up till right before the alleged crime happened with me and I braided his dreads. What, did he take his dreads down in that short amount of time and then allow the girl to re-braid his dreads while confessing to her???
Marchello was given an appeal public defender, he told Marchello that there’s nothing he can do, he don’t have no money to fight this case and the most he did was give us a copy of his trial transcript which Marchello ended up losing while being moved from prison to prison. So he never got an appeal.
Marchello also filed a habeas corpus saying the reason he lost his trial was due to ineffective counsel. He was not granted that as well.
I have been fighting to achieve justice for Marchello Jackson for the last 20 years. His daughter now of age, joins the fight for his freedom. We together are fighting to make sure his case finally gets a fair review. ineffective counsel and several other things led to Marchello Jackson being sentenced to 40 years.

The same is true in Marchello's case there were three officers there the night in question the arresting officer being one of the same ones from the above wrongful loss of life story above. All three officers had different accounts of what happened that night and we're disharmonious
Also that same arresting officer changed the setting of the alleged crime from the initial police report to his testimony during trial, and he lied and said he seen Marchello come out the parking lot of the club/hotel, but it was impossible for that to be true because where the officer said he was when he observed Marchello allegedly exit the club/hotel parking lot. He couldn't see the parking lot not only because it was too far away to see, but also because the street vears over and trees obstruct the view even if he could see that very long distance. If that wasn't enough, it was also at night...
Either he was super human or he lied???
During the trial the victims/witnesses were asked why they wrote $80 then crossed it out and then wrote $60. One of the victims/witnesses claimed that was because they were so shaken up that they meant $60, but wrote $80. The judge said that you cannot charge Marchello Jackson with robbery, because the money does not add up to the amounts that the victim/witnesses say it was that was taken from them. It’s not the amount that Marchello was found and arrested with, so it doesn’t make sense as to where the rest of money is. The judge got loud when he was talking about this issue. Marchello was picked up with $60 in his pocket and he said he had just got paid from work that day. In which the DA was asked during trial why they failed to verify whether Marchello was, or was not working. The DA also was asked why they failed to have the victims/witnesses wallets dusted for Marchello Jackson's finger prints, they claimed Marchello demanded the victims/witnesses wallets and searched through them each before throwing them down. If that was in fact the truth, Marchello's fingerprints would definitely turn up, but the state failed to do that. The judge said the money doesn't add up, so you can’t charge Marchello with robbery! So the Judge dropped those two counts of strong armed robbery. That's when the state's lawyer said "Well he tried to rob them, he tried!" The judge then allowed the charges to be picked back up as attempted robbery. During this one alleged crime act, the state brought forth against Marchello Jackson six total charges.
The only defense Marchello‘s public defender put up was, when one of the witnesses/victims wrote their statement, they ended the statement with a smiley face and who that was just robbed and taken from their destination would end their statements with drawing a smiley face. All the other things he could have presented, that's all he based his defense on??? He never even prepared a defense at all for Marchello. Also NO GUN (the alleged crime weapon) was ever recovered, so Marchello is convicted of having a non existant weapon.
It was said that two people committed the alleged robbery. Why was the second perpetrator said to have not been caught and the whole ordeal fell on Marchello Jackson being the master mind? They claimed that the second perpetrator was able to get away from the perimeter the police set up, they were able to dodge the dogs they sent after them and the helicopter, now does that seem like the truth???
After trial the jury then deliberated, it was a very short deliberation, less that an hour. How did the jury get through ten pages of jury instructions and make a sound decision in less that an hour. During the deliberation process, the jury came back with questions about the case. (The jury was made of an all white jury except one black man, the alternative juror was also white). The judge said that he was not going to answer one of the jury’s questions. And the other questions that the jury asked if they could get two copies of the transcripts to go over a couple things. The judge said tell them they would have to come back the next day, then per the transcripts, the judge stated, "That'll fix that". I guess the jury did not want to come back the next day. It's even in the transcript where a jury member is asking how long would this all take. That is when the jury came back with a guilty verdict on all charges brought forth on Marchello Jackson in the highest. (The jury was also instructed that they could convict Marchello without the gun enhancement because there was no gun recovered.) That means the jury closed the case with questions they had no answers to. That is making a decision with reasonable doubt.
A jury is not supposed to come to a conclusion of guilty if there is reasonable doubt, this case is filled with reasonable doubt...The judge then used his own biased discretion and unjust practices to hand down the harsh sentence that Marchello Jackson received.
There was no recovery of the alleged weapon used the night in question, though the weapon is what is holding so much weight in Marchello Jackson's case. The injustice then continued when Marchello Jackson was sentenced under the Florida’s 10-20-life sentencing statue. This statue was for cases that a gun was used. Marchello was charged under 10-20-life, but no gun was ever recovered in Marchello's case. This statue came on the tail end of Florida's tough on crime laws that were being enacted in the late 1990's by Governor Jeb Bush. In 2016 Governor Rick Scott ruled that 10-20-life sentencing statue was unjust and it was overturned, but not set to be retroactive. Though they admit that because of the statue many young minorities that probably should have gotten a second chance did not, and it is said that 10-20-life is also a direct effect to Florida's mass incarceration problem.
Rick Scott said the decision to overturn this bad unjust law is, because it took the discretion out of the judges hands and people were sentenced under one blanket decision. The judge was not allowed to apply their own discretion to the cases. However in the case of Marchello Jackson the judge was able to apply his own discretion, because he sentenced Marchello to four times the amount of time that was set according to the 10-20-life sentencing guidelines. Four times the amount that in 2016 was referred to as being unjust. I, in my heart believe that the judge was making an example out of Marchello. Shortly after the judge sentenced Marchello, he moved up from circuit court judge to supreme court judge. I always wondered how many other people the judge sentenced like this. The judge then served as supreme court judge since 2004.
When I met with Marchello‘s lawyer after his sentencing date, the lawyer served me a paper. He said "Here this is something that also played a part in Marchello getting convicted." It was a written statement from someone that Marchello asked to be subpoenaed to court to testify. Marchello's public defender said "No she can not be subpoenaed to court to testify because she was not a credible witness." But the same girl was credible enough to give a written statement. How does that make sense. That written statement was not presented during trial. The girl in the statement said she was with Marchello the entire time leading up to the time the alleged robbery took place. That was a complete lie because Marchello Jackson spent the entire day leading up to right before the time in question with me. Why wasn't I able to testify about his where abouts??? In the written statement the girl was said she was with Marchello the time leading up to the crime and she braided Marchello's dreads down. She said as she braided his dreads Marchello told her how he was going to rob someone. That is also a lie because Marchello spent the entire day leading right up till right before the alleged crime happened with me and I braided his dreads. What, did he take his dreads down in that short amount of time and then allow the girl to re-braid his dreads while confessing to her???
Marchello was given an appeal public defender, he told Marchello that there’s nothing he can do, he don’t have no money to fight this case and the most he did was give us a copy of his trial transcript which Marchello ended up losing while being moved from prison to prison. So he never got an appeal.
Marchello also filed a habeas corpus saying the reason he lost his trial was due to ineffective counsel. He was not granted that as well.
I have been fighting to achieve justice for Marchello Jackson for the last 20 years. His daughter now of age, joins the fight for his freedom. We together are fighting to make sure his case finally gets a fair review. ineffective counsel and several other things led to Marchello Jackson being sentenced to 40 years.
