My husband was recently involved in a serious hit and run wreck a few months ago. It's left us with not only in a hard place emotionally, mentally, and physically for my husband (bc he was injured in the wreck)... but it's really hurt us financially. 

We have two little boys who are 2 and 3 years old. Our 3 year old son, Colby, has down syndrome. Our 2 year old son, Trevor, has brain damage from a birth injury he endured during labor. Since both of our boys are disabled, only ONE of us can work because there are no special needs daycares. Therefore we only had one income to survive on, but the hit and run wreck took that income away as well. Due to losing our only form of transportation, because our Honda civic was hit by a big dually diesel truck- so naturally it was completely totaled, my husband lost a contract in a neighboring city installing security cameras and setting up their networking system. This is why we started a gofundme a couple months ago, but with moving into a new area 4 months prior to the hit and run we didn't have the correct avenues to ask people to help (plus, I've always had a hard time asking for help). We only had the required Florida state minimum car insurance, because that's all we could afford, so it only covered $10k of medical bills (after paying a 1k deductible). No reimbursement for our car. No loss of wages, no help at ALL. But it would have covered the other guy- who fled the scene of the crash, but not the victim who was left behind (my husband).

This petition is asking to change this. A motorist who has NEVER been in a accident, never received a ticket (of any kind), a motorist who has always paid and maintained car insurance, and practices safety on the roadways should not be penalized by a hit and run wreck. Especially a hit and run where local and state police confirm that the victim did in no way contribute to the wreck happening, nor did the victim have any way to avoid it. there was nothing in the driver's power to prevent the wreck (they weren't speeding, they were abiding by all traffic laws, etc). If the other driver flees the scene of the accident and it was their fault, coverage should be diverted to the victim of that hit and run wreck. The one that was left to die- like this motorist did to my husband. The motorist who fled had no knowledge of the condition of the driver in our vehicle or if there were any passengers for that matter.

Florida Highway patrol has YET to find this driver. There was even a formal compliant filed with the supervising officer of Troop C and the attorney General's office. Naturally, although many attorneys said otherwise, there were no "findings" of misconduct in-house. Not unusual huh? Unfortunately, due to negligence and fine print my family suffers due to another individuals selfish acts. This petition will make it to where a motorist who flees a wreck, in doing so, gives up their rights of compensation and insurance claims. Therefore, it should be awarded to the VICTIM of this type of crime. 

Help me change this so no other family has to lose everything they've worked for- like we did.

Why should the insurance company WIN when a motorist flees the scene of the wreck? If they're willing to cover the OTHER party with minimum coverage car insurance, then why not do it for your PAYING policy holder, who religiously pays their car insurance with YOUR company monthly?
