 Warrant issued for man charged in Alvarado case

A $15,000 cash-only bench warrant has been issued for a Morning Sun man accused of violating his pretrial release in connection with the death of Sadie Alvarado, court records show.

The Department of Correctional Services said in a report filed Thursday in Lee County Court that Damian L. Hamann, 28, violated the terms of his release Wednesday August 22nd when he was arrested on a misdemeanor charge of public intoxication in Louisa County.
 
As of today, August 31st, he has not been arrested on the warrant.

And we want to know what is taking the Lee County Sherrif, and Lee County Attorney so long to arrest him? 

This is my petition:

First and foremost, we would like to know why Damian Hamann hasn't been arrested on the warrant that was issued to him on August 22nd for getting arrested by the Louisa County Sheriff for public intoxication and violating the terms of his pretrial release. It has been 10 days since his arrest and that the warrant was issued, and he still hasn't been serve with it. I am sure that he is not hiding from the Louisa/Lee County Sheriff, so my question is, why is he still out? Is he getting some type of "privileges" ?

We are definitely not making this a racial issue, but I wonder if a Hispanic would've had committed the exact same crime, what would've had been their chances of being let out of jail the following day under pretrial release? Or the possibilities of still being out of jail after violating the pretrial release terms, and on top of that with an active warrant out for my arrest for doing so. I sincerely doubt that that would've had happened.

While the majority of us that personally knew her, friends, relatives, and parents are still grieving the lost of an amazing and brilliant young lady, he is still out there drinking, acting like nothing happened and a slap in the face that not even a month after being granted pretrial release and out without paying a dime he returns back to jail with a different charge. Or did he forget that the night that Sadie died he was also highly intoxicated that most likely was the reason that he decided to leave her behind, once again because of his selfishness. The lack of respect toward authority, and over all, the Lee County Courthouse, 8th Judicial District D.O.C and you, Distric Associate Judge Ty Rogers.

I am asking the Lee County Attorney and the 8th Judicial District to please revoke his pretrial release and keep him incarcerated until the case it's over. We believe in that everyone's "innocent until proven guilty", but there is too many people out here that believe that there is more to this story then what we are being told. We trust and have faith in the Iowa criminal justice system, and that justice will be serve. Until then, he is guilty in the eyes of most of us, and we will not sit here and let the State of Iowa, and especially Mr. Hamann, forget about Sadie.

¡ESTE ES MI PROBLEMA Y LA RAZÓN DE MI PETICIÓN!

Orden de arresto para hombre acusado en el caso de Sadie Alvarado.

Se le puso orden de arresto y con una fianza de $15,000 en efectivo para un hombre de Morning Sun acusado de violar su libertad provisional en relación con la muerte de Sadie Alvarado, según muestran los registros judiciales.

El Departamento de Servicios Correccionales dijo en un informe presentado el jueves en el Tribunal del Condado de Lee que Damian L. Hamann, de 28 años, violó los términos de su liberación el miércoles 22 de agosto cuando fue arrestado por un delito menor de intoxicación pública en el condado de Louisa.

Y hasta ahora, 31 de agosto, no ha sido arrestado.

Y queremos saber por que al Sherrif del Condado  y al Procurador del Condado de Lee  se le esta tomando mucho tiempo para arrestarlo!!

Mi peticion hacia el el Juez Rogers, Fiscal Braden, y Alguacil Weber.

Primero y ante todo, nos gustaría saber por qué Damian Hamann no ha sido levantado con la orden de arresto que se le otorgó el 22 de agosto por ser haber sido arrestado en el condado de Louisa por intoxicación pública y por violar los términos de su libertad provisional. Han pasado ya 10 días desde su arresto y que se emitió la orden de arresto, y todavía no se le ha encarcelado. Estoy seguro de que no se está escondiendo del Sherif o haiga sido capaz de haberse fugado, entonces mi pregunta es, ¿por qué todavía está fuera? ¿Está recibiendo algún tipo de "privilegios"?   

Definitivamente no estamos haciendo de esto una caso racial, pero me pregunto si un hispano hubiera cometido exactamente el mismo crimen, ¿cuáles hubieran sido sus posibilidades de poder haber salido de la cárcel al día siguiente en libertad provisional? O las posibilidades de todavia estar fuera de la cárcel después de no cumplir con las reglas de mi libertad provisional, y aparte por encima de todo, tener una orden de arresto activa por eso. Disculpenme, pero lo dudo muchisimo.

La mayoría de nosotros que la conocíamos personalmente, sus amigos, parientes y sus padres siguen destrozados por la pérdida de una joven increíble y brillante. En cambio el sigue bebiendo, y actuando como si nada hubiera pasado y es una bofetada en la cara que ni siquiera un mes después de que se le concedió la libertad provisional y la salida de la carcel sin haber pagado ni un solo chingado centavo, regrese a la cárcel con un cargo nuevo ¿O se le olvidó de que la noche en que murió Sadie también estaba muy ebrio, que probablemente esa haiga sido la razón y su motivo por la que decidió abandonarla despues de que supuestamente se haiga aventado de el carro.? La falta de respeto hacia la autoridad, las leyes y sobre todo, el Juzgado del Condado de Lee, el 8 ° Distrito Judicial, D.O.C y usted, el Juez Asociado del Distrito Ty Rogers, es mas que suficiente para revocarle su libertad provisional.

Le pido al fiscal del condado de Lee y al 8 ° Distrito Judicial, que por favor revoquen su libertad provisional y lo mantengan encarcelado hasta que termine el caso. Personalmente creo en que todos somos "inocentes hasta que se demuestre lo contrario", pero hay demasiada gente que cree que hay más de esta historia, de la que se nos dice, o el cuenta. Confiamos y tenemos fe en el sistema de justicia penal de Iowa, y que se hará justicia. Hasta entonces, él es principal culpable de la muerte de Sadie a los ojos de muchos de nosotros, y no nos sentaremos aquí callados y dejaremos que el Estado de Iowa, y en especialmente el Sr. Hamann, se olviden de Sadie.
