Revise Section 5a of the Drug Driving Law to Ensure Fair Prosecution
The Issue
Current UK law allows for the prosecution of drivers under Section 5a of the Road Traffic Act, even if they have not consumed cannabis on the day they're driving. The legislation does not seem to distinguish between those who are under the influence and those who are not. As a result, frequent cannabis users who are not currently impaired can be prosecuted simply because cannabis resides in the user’s body for an extended period. This places a major disadvantage on regular users who have not consumed on the day they drove and were driving safely.
Reports suggest that Cannabis can be detected in the body up to several days after use, with high levels not necessarily correlated to impairment (source: Advisory Council on the Misuse of Drugs, UK). As such practices could violate the premise of equality before the law, this measure needs a revision.
We demand that the law be revised to focus on actual impairment rather than mere presence of cannabis in the driver's system. This will ensure that drivers are only prosecuted when their driving is impaired due to drug use, protecting the rights of drivers who consume cannabis responsibly.
