Revise Pennsylvania’s Law For Dual Control Permits

In Pennsylvania, a dual control learner's permit authorizes a person to drive a motor vehicle equipped with a dual control system, specifically a second brake pedal accessible to a trained instructor in the passenger seat. This permit is primarily used for individuals who require specialized training due to a physical or cognitive condition, such as the use of hand controls. In Pennsylvania, the process for obtaining a dual control permit is significantly more challenging and time-consuming compared to a regular driving permit. Under Pennsylvania law section 84.2., an individual who does not complete their training within a 12 month period may reapply for a 12 month extension. However, under this law it states that the individual is only able to apply for two 12 month permit periods in the span of 5 years. This means that if the applicant is unable to complete their training within that second 12 month period, they then need to wait a 5 year period to reapply again. There are many reasons why a disabled individual may not be able to complete their training within the allotted time period, including unexpected medical events that render them temporarily unable to drive. When applying for a standard driving permit, an applicant is able to reapply as many times as needed. This law places an unnecessary and unequal regulation on disabled drivers, making it even more difficult for them to navigate the world independently, and takes away access to employment and education opportunities. By imposing this regulation, PennDOT indirectly curtails the independence and mobility of these individuals, leading to undue hardship and discrimination. The Americans with Disabilities Act (ADA) mandates that all individuals should have equal access and opportunities, yet this policy by PennDOT stands in direct contradiction to these principles. According to data as of April 2024, an estimated 18.6 million people reported having travel-limiting disabilities, with a notable portion relying on permits like these to maintain their autonomy and quality of life. Updating this law for dual control permits, will greatly improve lives. It will align with the equal protection requirements set out by federal disability laws and ensures equitable access to necessary resources for everyone in the state. By updating this Law, Pennsylvania can demonstrate its commitment to inclusivity and fair treatment for all its residents. Sign this petition urging the Pennsylvania Legislature and Governor to reconsider and adjust their law on dual control driving permits to afford the same options and freedoms to disabled individuals as their non-disabled peers.
