The Issue
I, like many others, have experienced first-hand the severe ramifications of Kentucky's outdated legislation revolving around divorce, child custody, and child support. After a gruelling 5.5-year divorce, I was stripped away from my parental rights for two years – all based on a court's judgement that I hadn't 'fought hard enough' to see my children. Heartbreakingly, I was denied even a chance to express myself in the courtroom.
In Kentucky, the law is structured to give certain advantages to mothers, resulting in many fathers like myself feeling unjustly penalized in custodial or financial decisions. The interpretation of these crucial laws is left to the discretion of a judge, who may not have full understanding of the family's unique circumstances. How can one person make such critical decisions about a child's best interests without truly knowing them?
Furthermore, the current system leans heavily on inconsistent income determinations for child support obligations. Despite both parents having gainful employment and shared custody with no designated primary parent, I am mandated to pay child support simply because I earn more.
Legislative change is imperative. We must ensure that Kentucky's divorce, child custody, and child support laws are updated to reflect the reality of today's diverse family dynamics. Legislation should prioritize children's welfare, not their gender, and should foster transparency, fairness, and integrity in judgement made within the family court system.
