Review the DUI laws!
The Issue
On February 17th, 2011, Brittany Walker (20) and Emily Jean Mills (5) were in a car crash caused by a drunk driver in Montgomery County, Tennessee. Emily Jean nearly lost her life that night and suffered from several injuries. As a result from the wreck, Emily is paralyzed with a 2% chance to walk again.
The drunk driver, Kristopher Colbert, was convicted of his 1st DUI and 2 counts of Vehicular Assault. Colbert was sentenced to eight (8) years in the Tennessee Department of Correction. Colbert was released after serving five and a half years for good behavior.
In August of 2018, two years after being released from prison, Colbert was arrested and convicted for DUI 2nd. Colbert was sentenced to twelve (12) days in jail. The Judge told Colbert if he is arrested a 3rd time for a DUI he will serve 90 days in jail.
The law currently states In Tennessee, a DUI becomes a Class E felony upon a fourth or subsequent conviction. Penalties are increased with imprisonment set at a term of at least 150 consecutive days and no more than the appropriate maximum sentences set out by statute. The court prohibits the offender from driving a motor vehicle for 5 years.
This petition is stating we need to review and possibly change DUI laws!
If you were convicted of a DUI that also involved a felony offense(s) such as felony property damage, serious bodily injury, or death and you are later on convicted of yet another DUI, that DUI automatically becomes a Felony Offense. Example: You were convicted of DUI 1st and Vehicular Assault. You are sentenced to four years in prison and you eventually expire this sentence. If you get released and get arrested for yet another DUI, that DUI becomes a felony.
