Reverse Recent Parking and Enforcement Rules Implemented by Somerset Green HOA, Inc.

The Issue

To the Board of Directors and Members of Somerset Green:

We, the undersigned residents and homeowners of Somerset Green, hereby express our strong dissatisfaction and objection to the recent parking rules that were implemented by the Board of Directors under the Eighth Supplemental Notice of Dedicatory Instruments for Somerset Green Homeowners Association Inc. These rules, which were enforced without adequate consultation or consideration for the community's needs, have imposed undue burdens on residents and have led to significant inconvenience and frustration.

The recent parking regulations, active enforcement by patrol guards, and unreasonably stringent permit requirements, have negatively impacted our ability to comfortably reside in our own community. These rules not only restrict our freedom but also create unnecessary stress and conflicts among neighbors, particularly as it relates to our guests and visitors. Further, the use of extremely sticky adhesive on the windshields of violators is excessive and unwarranted. Such aggressive tactics not only escalate tensions within the community but also reflect negatively on our HOA's reputation.

The practice of guards actively patrolling the neighborhood compromises safety at the front gate, where guards are no longer always present, potentially leaving a vulnerability in the community's security.

We collectively voice our apprehension regarding the inconsistent policy enforcement on parking, which has resulted in residents refraining from hosting guests (including family members) due to the uncertainty and potential inconvenience it poses, thereby hindering our ability to enjoy our community and maintain social connections.

The implementation of new parking rules without adequate consultation from homeowners, particularly before the community was fully built out, has caused frustration and discontent among residents. Many current residents feel sidelined as they were still in the process of constructing their homes when the new policies were decided in the second half of 2023. This lack of inclusivity in the decision-making process has strained trust between residents and the Board of Directors.

Therefore, we demand the immediate reversal of these unjust parking rules and urge the Board of Directors to take the following actions:

  1. Remove parking permit requirements for guests and visitors visiting for less than 14 days.
  2. Cease proactive enforcement of parking policies by the guards, particularly those targeting visitors and guests, including stopping the use of a sticky adhesive citation on the windshields of violating vehicles. Instead, the guards should maintain 24/7 presence at the front gate to prioritize neighborhood safety at the entrance.
  3. Remove the requirement that perpendicular parking spots, which are currently intended for “short term parking” only, are not permitted for use during overnight hours from 2am-6pm. Most of these so-called “short term” parking spots (that are almost always empty) do not have any signage whatsoever, and for many homes are the closest striped parking spots for their visitors and guests.
  4. Establish a transparent and inclusive process for discussing and implementing any future changes to parking regulations and other policies, ensuring that the voices of all residents are heard and respected.
  5. Provide clear justification for any proposed parking rules, including evidence of their necessity and potential impact on the community.
  6. Hold accountable those responsible for the unilateral decision to implement these rules without proper consultation and transparency.
  7. Revoke the recently enacted parking regulations until a comprehensive review can be conducted with input from all community members.

Failure to address our concerns and take appropriate action will leave us with no choice but to explore all available avenues, including but not limited to legal action and/or the removal of current board members through a vote of no confidence.
