Restore Gun Rights to Non-Violent Misdemeanor Offenders After Five Years
The Issue
I am one among many who have lost their gun rights due to a non-violent misdemeanor offense. In my case, it was a crime I did not commit, but circumstances forced me into pleading guilty. This personal experience has led me to understand the need for reform in our legal system.
There are countless others like myself who have been stripped of their gun rights due to non-violent misdemeanors. The current law is unyielding and does not consider the nature of the offense or the character of the individual beyond that single incident.
We propose that those with misdemeanor offenses punishable by more than one year should be given an opportunity for redemption. If they maintain a clean record for five years following their conviction, their right to bear arms should be automatically restored.
This change would provide an incentive for good behavior and rehabilitation while still maintaining public safety. According to research from The Sentencing Project, recidivism rates significantly decrease after five years without reoffending (The Sentencing Project, 2011).
Our proposal respects both public safety concerns and individual rights. It allows individuals who have made mistakes but demonstrated consistent lawful behavior thereafter, like myself, to regain our constitutional right.
