Subject: Reversal of Toilet Access Restrictions at Rhyl High School
We express our deep concern over the recently implemented policy at Rhyl High School, which restricts student access to toilet facilities during school hours. While we recognize the need to address issues such as vaping and misbehavior, the current approach — which locks toilet facilities for the majority of the school day — unfairly penalizes all students, rather than targeting the specific individuals responsible for violations.
This policy is not only restrictive but may also be in violation of several rights and legal provisions aimed at safeguarding student wellbeing, health, and dignity. We ask that the school leadership and local authorities reconsider this decision and provide a more balanced, student-centered approach that addresses misuse without compromising basic needs.
Our Concerns -
Health and Safety at Work Act 1974 and The Education (School Premises) Regulations 2012
Health Risks: Denying students access to toilets for extended periods of time can lead to serious health issues, such as urinary tract infections, bladder problems, and unnecessary stress. These laws require that schools provide adequate and safe access to sanitary facilities, which this policy undermines.
Equality Act 2010
Indirect Discrimination: The policy may disproportionately affect female students who may need sudden access to toilets due to menstruation. Additionally, students with medical conditions should not be forced to disclose sensitive personal information to obtain a “toilet pass.” This may violate the Equality Act 2010, which protects individuals from discrimination on the grounds of gender and health.
Article 8 of the European Convention on Human Rights (ECHR) and Data Protection Act 2018
Privacy Breach: Requiring students with medical conditions to obtain a “toilet pass” compromises their right to privacy. Forcing students to disclose health issues they may wish to keep private is an unjustifiable invasion of their privacy.
Human Dignity: All students have the right to access basic facilities like toilets when needed. Limiting access to a basic human necessity undermines their dignity, a principle upheld by both common law and the Human Rights Act 1998.
United Nations Convention on the Rights of the Child (UNCRC)
Best Interests of the Child: Under this convention, children’s best interests must be a primary consideration in all decisions that affect them. Limiting toilet access without sufficient alternatives is not in the best interests of students' physical or emotional wellbeing.
Education Act 1996
Parental Rights: Parents have the right to ensure that their child’s education promotes their health and wellbeing. We believe this policy compromises that right by endangering students’ health and mental wellbeing.
Our Request
We respectfully urge Rhyl High School, Denbighshire County Council, and the Welsh Government to:
Reverse the current policy of locking the toilets during school hours, and provide more flexible access to students during class time.
Implement alternative measures to address the issue of vaping and misbehavior in toilets without penalizing the entire student body. This could include:
Increased staff monitoring of toilets during break times.
Installing more discreet security measures such as vape detectors.
Ensure equality by providing open access to all students without requiring the disclosure of personal health information. Toilet access should be considered a fundamental right, not a privilege to be restricted.
Improve communication with parents and students about the reasoning behind policies and ensure that all decisions prioritize student welfare and adhere to relevant laws and regulations.
By signing this petition, we support the call for Rhyl High School to reconsider its toilet access policy in a manner that upholds the health, rights, and dignity of all students. We ask the school to adopt measures that target behavioral issues without compromising the wellbeing and basic rights of every student.
