The Issue
Neighbors, friends, fellow volunteers & concerned constituents,
I would like to request your support and approval, by signing this formal resignation request of the current Gwinnett County Attorney, Michael Ludwiczak.
Mr. Ludwiczak deliberately spent $24,767.20+* of tax-payer funds to align on a civil "MERITLESS" Suit with Mr. Stephen Hughes of Gwinnett County on the case "STEPHEN HUGHES VS. GWINNETT COUNTY".
(Yes, you are reading that correctly. Gwinnett County made themselves a party in alignment with the Plaintiff Stephen Hughes - against themselves as a Defendant.)
*$24,767.20+ is the current calculation of funds with an outstanding fee- affidavit pending for the additional time and resources Mr. Ken Jarrard applied to this case that was heard in the Gwinnett County Superior Court on September 9, 2024 at 1:30pm in Courtroom 102 at 75 Langley Drive Lawrenceville, GA before the Honorable Tadia Whitner.
As you know, our Gwinnett County finances should be protected, utilized, and outsourced with the application of sound judgement by our County officials and leadership under the pretense they will execute their fiduciary duty to their respected constituents.
Yesterday's performance of Gwinnett County's third-party attorney in Superior Court was nauseating to witness; as our fiscal operating budget was being spent for such a dismal, unreasonable, and unjust cause. The lack of judgement, leadership, and compassion for the situation at-hand showed there is a much larger agenda/ bias that currently exists.
Gwinnett County's position should have remained unbiased' and they should have professionally recused themselves by remaining within compliance of all ethics standards and Georgia Rules of Professional Conduct.
Regardless of direction or potential explanation, Mr. Ludwiczak's position, purpose, and function is to protect the best interests of the community, as a liaison, acting on behalf of the Board of Commissioners. His role is to make sure the Commissioner's reputation, the Gwinnett County interests, and the those of the constituents are maintained on all business matters and/or are within compliance and application of good-faith business practices.
Unfortunately, we as a community feel the use of these funds were used in bad-faith in a sole effort to circumvent, invoke, and interject a position of contradiction and opposition to what the voters clearly stated they wanted through a certified election of Senate Bill 333 - The City of Mulberry.
That definitively places doubt and concern surrounding the misappropriation of those funds for purposes Gwinnett County should have applied to recuse themselves from and remain a "neutral" party.
The contradicting documentation and testimony clearly indicates that did not take place at the direction of Mr. Ludwiczak.
I hope you will join our concerned community in requesting The Gwinnett Board of Commissioners ask for Mr. Ludwiczak's resignation by signing this petition that will be presented to the Board of Commissioners in the proper venue and/or at the next available scheduled meeting.
