Keep Fishkill Beautiful by Adhering to Town Codes When Building!
The Issue
There is a request for 110 unit apartment buildings, a park, as well as a child care facility (proposed tax exempt, for 108 children plus staff) proposed on the property of the Church of the Nazarine on Route 52 in Fishkill.
This project would be built on both Town and Village Land.
The PARK falls on the Town of Fishkill property.
The 110 APARTMENT UNITS (currently proposed as a 110 unit, 3-story housing with associated parking, landscaping and maintenance sheds) falls on Village property.
Because the project is so large in scale, it breaks many of the current zoning laws. For that reason, the owners are requesting multiple variances and zoning changes.
Here is a list of variances they are requesting in order to get around the Town Code:
Variance #1 Reduction of the front yard setback to 33' (35' is the minimum). What this means: they are asking to have the buildings built closer to the road than are permitted.
Variance #2 Reduction of the back yard setback to 24' (40' is the minimum). What this means: They are asking to cut the amount of space required in the back yard almost in half, to bring their project closer to the property line than permitted.
Variance #3 An increase in the maximum lot coverage to 61% instead of 20%. What this means: They want to triple the amount of building allowed on the property.
Variance #4 A request to allow a lot depth of 72' where 125' is required.
Variance #5 A request to include more than 10% of land that is subject to flooding.
Variance #6 A request to allow 100% of lands under water to be included in the gross lot area where 50% is the maximum permitted.
