Royal Park Estate Bylaws (Langata, Nairobi, Kenya)

The Issue

We, residents of Royal Park Estate, agree as follows:

(1) All new developments in the estate must strictly follow zoning requirements and ensure that they comply with the official plan which sets out the estate’s general policies for future land use (“single unit family dwellings”). Zoning in this estate has specific requirements that have been agreed upon by all resident members, and which are legally enforceable. Constructions and new developments that do not comply with these bylaws and which, ipso facto, tend to negate the value for money of existing estate buildings, are not allowed, and the residents of the estate will refuse to accept buildings that are not built to comply with the existing mansionette character of the estate.

(2) All new developments in the estate are compulsorily required to share with estate residents, through their elected committee members, their housing development plans and approvals thereof by the Nairobi county government. No developments will be allowed to proceed without sharing these plans, and residents retain the right to block continued development of houses that include illegal apartment buildings.

(3) Estate committee members and the residents in general have the right and leave to inspect and investigate any property within the precincts of the estate, as well as licensed and permitted businesses and premises, to ensure compliance with these neighbourhood bylaws and regulations. This will help to maintain a high level of public safety, neighbourhood integrity and cleanliness, and value for money for estate residents.

(4) The land, common areas and infrastructure usually referred to as ‘common property’ are collectively owned by all unit owners of the housing scheme. As a result, every house owner/occupier automatically becomes a member of the Royal Park Estate community and is required to abide by our communal rules and regulations

(5) Residents categorise as nuisance the following: residents playing loud music, loud parties, shouting, pouring or throwing water or litter through the windows, littering the estate, obstructing household entrances with their vehicles, hooting excessively, speeding within the estate above 30 KPH, and obstruction within the estate roads and Courts. No repairing of vehicles within the estate will be allowed under any circumstances. Movement of household items within the estate without informing the guards at any of the three main estate entrances is not allowed, in the interest of security. No parking of vehicles is permitted along the driveways, especially along the main thoroughfares (Jeylaani Boulevard, Sunset Avenue, and Baran Drive).

(6) In addition, there will be no storage of unserviceable and accident vehicles within the estate such vehicles are not only eyesores but unnecessary strain on the scarce parking bays available.
