

Require Utah Child Care Staff to Show Proof of MMR Vaccination During Measles Outbreak
The Issue
Updated Petition - June 9, 2026:
As of today, Utah's measles outbreak has grown to 679 confirmed cases, with 482 occurring in 2026 alone. The outbreak continues to grow.
Here is something most people do not know: Utah law requires licensed daycares and preschools to document immunization records for every enrolled child, but there is no equivalent requirement for staff. The adults caring for our most vulnerable children are not required by state licensing rules to show proof of MMR vaccination.
After months of engaging with state officials, the Utah Division of Licensing and Background Checks (DLBC) confirmed that closing this gap requires legislation, not just a rule change. This petition now has two goals:
- Demonstrating to the Utah Legislature that there is community support for passing a bill in the 2027 Utah General Session explicitly authorizing DLBC to require child care staff MMR vaccination.
- Informing parents of this issue and encouraging them to ask their child care program to require proof of MMR vaccination for staff. Daycare and preschool employers already have the legal authority to do so today through the exemptions in Utah H.B. 131 (2023).
We require children to prove they are protected before they can be enrolled. We should require the same of the adults caring for them.
Original Petition - March 18, 2026:
Utah has over 400 confirmed measles cases and the outbreak is accelerating statewide. Infants under 12 months cannot receive the MMR vaccine and depend entirely on the vaccinated adults around them for protection (Note: Infants between 6 and 12 months can receive an early dose after consulting a pediatrician, but must still complete the standard two-dose series beginning at 12 months). Here is a gap most people do not know about: Utah law requires licensed daycares and preschools to document immunization records for enrolled children, but there is no equivalent requirement for child care staff. The adults caring for our unvaccinated infants are not required by state licensing rules to show proof of MMR vaccination. The legal authority to fix this already exists. Utah H.B. 131 (2023) specifically exempts child care programs from the state's ban on employer vaccine mandates. The Utah Division of Licensing and Background Checks (DLBC) can amend child care licensing rules R430-100 and R430-90 without waiting for the legislature. Join me in asking DLBC to act now, through emergency rulemaking, to require child care staff to provide proof of MMR vaccination. As a parent of an infant under 12 months of age who is currently enrolled in a licensed child care program in Utah, my baby is depending on the adults around her and on our Utah health officials to close this gap.
