As a staunch believer in checks and balances, I see a critical gap in the current process concerning executive orders. While I recognize the president's need for the authority to make swift administrative and crisis-related decisions, it is essential that these decisions remain within legal parameters. Currently, any executive order can be temporarily halted by any of the 677 District Judges, triggering a lengthy process of appeals that can indefinitely delay important actions.
This petition addresses the need for all executive orders to undergo mandatory judicial review at the Circuit Court level before they are implemented. This proposal aims to put these orders at the top of the docket where legal issues can be rapidly assessed. Expedient judicial review would not only ensure that orders are legal and constitutional but also allow them to come into effect swiftly, thus reducing controversy and potential collateral victims.
Reforming this process would uphold the integrity of the executive branch while ensuring that the necessary legal frameworks are in place to support its actions effectively.
