The Issue
We, the undersigned residents of California, respectfully petition the California Department of Public Health, the State Legislature, and Solano County Public Health to require that all beverages delivered through platforms such as DoorDash, Uber Eats, Grubhub, and similar services be packaged with full tamper-evident seals that secure the entire lid. Current single-sticker or straw-hole covers do not prevent tampering and pose real health and safety risks to consumers. This petition calls for a uniform statewide standard that makes drink tampering impossible without visible evidence, protecting every Californian who orders beverages for themselves or their families.
Problem & Rationale
Current practice is insufficient
Many delivery services or restaurants only cover the straw hole or put a minimal seal. This allows the rest of the lid to be popped off easily.
In multiple reported incidents, drivers have opened the lid, tampered with the drink (e.g. sipping, adding something, spitting), then resealed it, and still delivered it. For example, surveillance video caught a delivery driver removing the top of a smoothie, drinking from it, and putting the lid back on before handing it off. NBC 6 South Florida
In an even more disturbing case, in Utah, a man ordered a milkshake via Grubhub and later discovered that the delivered cup was actually filled with urine. The driver claimed he had mixed up the cups, stating he used a cup in his car for urination during long hours on the job. FOX Business
These are not isolated. Tampering of delivered drinks is a plausible risk when lids are not securely sealed.
Health & safety risk
Tampered drinks can introduce pathogens, foreign substances, or even harmful chemicals.
Even absent deliberate harm, opening a lid can introduce contamination (dust, bacteria, insects, etc.).
There is precedent in food safety law for requiring tamper-evident packaging in many consumables. Tampering is recognized as a crime in many jurisdictions.
Ensuring secure, tamper-evident seals would deter malicious tampering (or at least make it easily detectable), thus protecting consumers — especially vulnerable populations (children, immunocompromised, etc.)
Consumer expectation & justice.
When customers pay for a drink, they expect their product to arrive in its original state, sealed and untouched.
It is unfair to force consumers to assume risk or surveillance (doorbell cams, video) just to ensure their drink is safe.
Requiring this as a legal standard shifts responsibility to the delivery/food provider side, which is where control can and should lie.
Proposed Requirements (Legislative / Regulatory)
Full-wrap sealing: The lid and cup must include a tamper-evident seal that overlaps all edges, making it impossible to remove the lid without visibly breaking the seal.
Tamper-evidence: The seal must clearly indicate if it’s been opened — e.g. by visible tearing, color change, or a “VOID” pattern, etc.
Compliance testing & penalties: The food safety authority should have the power to inspect, test, and penalize non-compliant businesses (fines, license revocation, etc.).
Phase-in period & cost assistance: Offer a reasonable implementation timeline (e.g. 6–12 months) and support for small vendors to adapt.
Consumer notices: Delivery receipts / order confirmations should state that the drink will arrive with a full tamper-proof seal, so customers know the standard.
