Request to Add Recall Provision to Fayetteville City Charter
The Issue
Fayetteville residents presently lack a statutory mechanism to recall municipal officials, even in circumstances where there is substantial evidence of negligence, misappropriation of taxpayer funds, or issues affecting public safety. According to North Carolina law, the establishment of a recall process requires a Local Act enacted by the General Assembly.
In recent years, our community has experienced significant project setbacks and instances of financial mismanagement, resulting in substantial losses of taxpayer funds due to inadequate oversight. These include expensive lawsuits with minimal recovery of funds and additional costs arising from contract breaches. Concurrently, the enactment of ordinances—such as curfews and regulations relating to encampments—has generated considerable public safety concerns.
Collectively, these challenges underscore a systemic issue: the absence of an accountability mechanism between election cycles. When leadership fails, residents lack a timely means to address their concerns, leading to diminished public trust in government and heightened fiscal and safety risks.
To address this, Fayetteville voters merit a legally sound and democratic method for ensuring local official accountability. We respectfully urge the North Carolina General Assembly to enact a Local Act amending the Fayetteville City Charter to incorporate a recall provision, thus empowering voters to initiate a recall election should leadership fail to act in the public interest.
This proposal would permit a recall election only if 25% of registered voters sign a petition, ensuring that the process is substantive and community-oriented rather than politically motivated. In light of ongoing concerns regarding public safety, insufficient ordinance enforcement, and inefficient use of taxpayer resources, it is clear that our community requires a lawful mechanism for accountability between regular elections.
