Request for Official Clarification and Condemnation of Unsubstantiated Allegations Concern
Request for Official Clarification and Condemnation of Unsubstantiated Allegations Concern
The Issue
We, the undersigned residents of Frisco, Texas, respectfully submit this petition to request official clarification, factual context, and responsible leadership regarding recent public allegations of H-1B visa fraud and the broad association of such claims with the Indian community.
These allegations have been circulated without verified findings or publicly available enforcement actions and risk causing reputational harm to a legally compliant population of residents. Public discourse that casts collective suspicion on an entire community is inconsistent with the principles of due process, equal protection, and good governance.
Legal and Policy Context
Federal Jurisdiction Over H-1B Visas
The H-1B visa program is governed by federal statute and regulation and is administered exclusively by:
U.S. Citizenship and Immigration Services (USCIS), and
The Department of Homeland Security (DHS).
These agencies are vested with the authority to:
Review and adjudicate petitions
Conduct audits and site inspections
Investigate suspected fraud
Deny or revoke petitions
Refer matters for civil or criminal enforcement
Local governments and community members do not possess investigative or enforcement authority over federal immigration programs.
Due Process and Evidentiary Standards
Allegations of fraud require:
Individualized evidence
Formal investigation
Administrative or judicial findings
Absent such findings, public assertions of wrongdoing remain unproven allegations, not facts. Policy discussions must be grounded in documented enforcement outcomes, not assumptions or generalized claims.
Impact on a Law-Abiding Community
The Indian and Indian-American community constitutes an estimated 18–19% of Frisco’s population and includes residents who are:
Lawfully present under federal immigration law
Significant contributors to the local tax base
Employed in critical sectors such as healthcare, technology, education, and small business
Broad public allegations linking this community to fraud without specific findings risk:
Encouraging discriminatory treatment
Undermining public trust
Exposing the city to reputational and legal concerns
Municipal leadership has a duty to avoid rhetoric or silence that could reasonably be interpreted as endorsement of misinformation or collective blame.
Request for Municipal Leadership and Accountability
We respectfully request that the Mayor of Frisco and the City Council:
Publicly clarify that immigration compliance and fraud enforcement are matters of federal jurisdiction handled by USCIS and DHS.
Affirm the principle of due process, including that allegations require investigation and adjudication before conclusions are drawn.
Disavow collective or ethnic-based allegations that lack evidentiary support.
Commit to evidence-based public communication that protects all residents from misinformation and stigmatization.
Silence from elected leadership during periods of public misinformation can reasonably be perceived as a failure to exercise civic responsibility and risks eroding community cohesion.
This petition does not seek to influence federal immigration policy or shield wrongdoing.
It seeks to ensure:
Accurate public understanding of legal processes
Respect for due process and jurisdictional boundaries
Equal treatment of all communities under the law
Frisco’s governance should reflect constitutional values, factual integrity, and responsible leadership.
By signing this petition, we call for fact-based governance, legal clarity, and public leadership that rejects misinformation and collective blame in favor of due process and equal protection.
