Repeal SACAP's Preapproval of Registered & Unregistered Person's Association
The Issue
MY STORY:
In June 2006, I registered as a Candidate with the South African Council for the Architectural Profession (SACAP). Despite my dedication and passion for architecture, I've remained a Candidate for 19 years, facing numerous challenges, including disputed payments, penalties, and hurdles in advancing my career. SACAP's practices have hindered my professional growth, including denials of opportunities to sit for the Professional Practice Examination (PPE).
To progress in my career, I've sought employment and associations with genuine architects. However, SACAP's current practices are overstepping their mandate, attempting to control who registered persons can associate with. This blatant disregard for our rights, as enshrined in the RSA Constitution (Section 18) and the Architectural Profession Act (Section 26(3)a & (4)), is unacceptable.
My story is not unique as there are many who have similar & worse concerns/complaints/challanges with SACAP.
PETITION DESCRIPTION:
SACAP requires registered persons to seek preapproval before associating with others. This requirement is overly restrictive, infringing on our right to freedom of association.
GOAL:
We aim to repeal the preapproval requirement and substitute it with a new category and professional-associate agreement.
ARGUMENT:
SACAP's requirement contradicts the RSA Constitution and the AP Act, which protect our right to freedom of association. The public is sufficiently protected as registered persons are responsible for their work and subject to SACAP's Code of Conduct.
BENEFITS:
Repealing the preapproval requirement would allow for more collaboration, innovation, and entrepreneurship, ultimately benefiting the public.
PROPOSAL:
We propose:
1. A new category, General Architectural Practitioner (GAP), for formal associates to practice flexibly and limited to Archi-Stages 1-4.1.
2. A non-discriminatory Professional-Associate agreement to ensure associates act in the public interest.
3. Engage with both independent & SACAP associations in fine-tuning the details of above proposal.
PLEA/DEMAND:
We call on SACAP to:
1. Recall the preapproval policy and allow registered and unregistered persons to collaborate freely.
2. Create a new category: GAP.
3. Develop a Professional-Associate Agreement.
