

Repeal home cultivation limits in New York's MRTA
The Issue
The Marihuana Regulation and Taxation Act (MRTA) in New York State is a landmark legislation that marks a significant step towards the end of cannabis prohibition. However, certain provisions within the act, particularly those concerning personal home cultivation limits, pose a significant challenge to individual rights and the spirit of personal freedom.
Under Section 115.3(c) of the MRTA, individuals over 21 years of age are restricted to planting, cultivating, harvesting, drying, or possessing no more than three mature cannabis plants and three immature plants at any one time. Furthermore, Section 115.3(d) limits the total number of plants in a private residence to six mature and six immature plants. These constraints are overly restrictive and fail to recognize the full spectrum of cannabis cultivation.
The decision to cultivate cannabis at home is a personal choice that allows individuals to better understand the plant and how it affects their bodies. For many, especially patients who require cannabis for medicinal reasons, home cultivation ensures consistent access to strains and formulations that best suit their specific health needs. Moreover, limiting the number of plants can hinder efforts to produce sufficient quantities for personal consumption without resorting to commercial purchases, which can be cost-prohibitive for many individuals.
Personal cultivation limits can also discourage New Yorkers from exploring sustainable practices and from experimenting with new growing techniques. Many commercial growers begin learning at home. Limits on home cultivation restrict the ability of novice growers to learn the craft. Additionally, lifting cultivation limits can stimulate a culture of knowledge exchange among home growers, fostering community ties and educational opportunities about cannabis.
We urge the New York State Office of Cannabis Management to revisit these provisions within the MRTA and consider repealing the personal home cultivation limits. By doing so, they will empower their constituents, respect personal liberties, and foster education and sustainable practices within the state.
