Following up with the MBPJ Representatives who attended onsite on 22 July 2026.
Mr Afanizam, Jabatan Aduan (MBPJ Complaints Department)
Mr Raj, Jabatan Kawalan Bangunan (MBPJ Building Control Department)
Mr Mahadzir, Jabatan Kejuruteraan (MBPJ Engineering Department)

- Met in person, finally.
- He does not have the latest update after the team visited the site on 22 July 2026
- Encik Mahadzir is now the person in charge, however he is on leave today.
- Advised to speak with Encik Afanizam at Jabatan Aduan across the road at Bangunan Annex MBPJ.
-❗️While he doesn't know the full story, what he will say that it is not legal to build over 'parit kerajaan'. In some cases, a 'temporary' permit is given to a landowner to apply a 'softcover' over the parit however access is always possible for cleaning and maintenance.
Bangunan Annex MBPJ Jabatan Aduan - Encik Afanizam
- They are a preparing a notice for house #6.
- According to JUPEM Mylot https://jupem2u.kul.jupem.gov.my/MyLot/negeri.html , it appears that house #2 & #4 have built on land that is within their boundary.
- When asked how is this within their boundary if it used to be an open 'parit' passage and when Encik Nordin said that at most a 'temporary permit' for a 'soft cover' is provided to a landowner - Encik Afanizam said further investigation is required.
- Encik Afanizam said he is not a technical person and he needs to follow up with the other departments.
- When asked how JUPEM defined this, he said this is likely a conversation between JUPEM and Jabatan Kawalan Bangunan ... then sent me to Level 2 to speak with a representative.
Bangunan Annex MBPJ, Level 2, Jabatan Kawalan Bangunan - Mr Raj
- Mr Raj was the one that called us and asked to come over last week
- Mr Raj & his colleague Mr Haniff advised that this matter falls under the Engineering Department, i.e. where we started this morning with Encik Nordin.
- From his perspective, it is clear that private property has been built over MBPJ land.
- Mr Haniff advised to keep following up with Mr Mahadzir. In his opinion, the Engineering Department needs to send notice to the landowners and the landowners will need to provide proof of approvals to have built the way that they have.
What are the questions to be asked in this scenario?
Each department representative at MBPJ didn't really have a firm answer. How did JUPEM approve the boundary across MBPJ's parit kerajaan? En Haniff from the Building Control Department suggested that there may have been guidelines that were not followed, or that people can argue on the naked eye measurement definitions. He says a professional surveyor will settle this however it lies under the jurisdiction of MBPJ Engineering Department, not Kawalan Bangunan.
Encik Afanizam said he wasn't sure but thinks he's heard of a line of thought where bungalows no longer need a back access lane. Then he said he really isn't a technical person so he doesn't know and that this case is a little complicated and a few more steps will need to be taken to figure it out...
Are there new laws that stipulate that these emergency passageways are no longer relevant today? Encik Afanizam says that Lot 706 has clearly breached onto MBPJ's land and they will be receiving a 14-day notice soon. So that little passage still does matter to MBPJ. How does it make sense that the rest of the passage is sealed/privatized?
Is this a JUPEM <-> MBPJ conversation?
Whose role will it be to find out from JUPEM? Do we the concerned community members need to be the ones that raise the enquiry with JUPEM? Or will MBPJ get back to us once they have clarified matters with JUPEM?
Does this mean that all households of Jalan 5/35 and Jalan 5/37 can extend their boundaries at the back of their houses? On what grounds are these extensions approved?
What was the original design purpose of these passageways? How do these passageways serve the council today? Have the building acts that determined they are OK to be privatized and closed on one end been updated?
It will be interesting to learn.

This was more or less what I gathered from the circus runaround today. Ran out of time again as it was now their lunch hour. Honestly, I really enjoyed meeting all the characters involved with the case so far. Most of them seemed very clear on what their role and responsibilities are. Which begs me to question how did this seeming breach happen in the first place? It is also interesting that I was asked, why didn't I file a complaint earlier, to which I responded, I did and nothing changed.
