Thank you for visiting the site last 22 July 2026. We appreciate you taking the time. After your visit, I visited to speak with each of you again to follow up on 3 August 2026 (En Afanizam - Aduan), En Raj - Kawalan Bangunan, En Nordin - Kejuruteraan, did not make site visit but official PIC on this case)) then again on 5 August 2026 (En Mahadzir - Kejuruteraan, case has been assigned to him by En Nordin). In summary, based on a JUPEM MyLot map, it appears as if house #2 & #4 have built within their boundaries. However, house #6 has not. Therefore house #6 will be issued a notice for a second time.  

Question #1 - How is the current notice going to house #6 different from the previous notice given when I filed a first complaint in 2023 (Aduan JUL2312081)? After that first notice, no change happened and MBPJ closed the Aduan JUL2312081 without any follow up conversation with us.  

As for house #2 & #4, I expressed that as residents on this street for almost 40 years, we ran all the way through the back drain from one end to the other. I was then asked if the passage has been closed for a long time. I answered that house #2 was built a couple years ago. But house #4 & #6 just finished building and just moved in. We were not aware that house #2 had closed the very end. We only investigated and found out it was completely wrapped closed when house #6 started closing over the 'parit kerajaan'. After house #6 built over, house #4 followed suit within the past year plus. 

The Engineering Department, both En Nordin and En Mahadzir have expressed that this is definitely 'parit kerajaan' as far as they can tell, however they are uncertain how it is that JUPEM's boundaries have crossed over it and allocated it as a private boundary.  

Question #2 - So the question in our discussions became how is it that JUPEM has allowed the boundary to go across a 'parit kerajaan'?  

En Mahadzir suggested that another site visit needs to occur with full access to the 'parit kerajaan' areas at the back of houses #2 & #4. He suggested that this visit needs to include all of the above stakeholders plus Jabatan Tanah & Galian as well as potentially JUPEM representatives. He said that he will need to talk to En Afanizam to coordinate such a gathering where they will need to call ahead to gain permission of entry to houses #2 & #4. 

It is clear that this is a multistakeholder project. However, I am also hearing the Engineering department say that this project needs to be under the jurisdiction of Jabatan Kawalan Bangunan as housing structures are literally on the parit kerajaan areas, and then Jabatan Kawalan Bangunan argue that this matter has to do with 'parit kerajaan' so they hold court. 

It is both, as I expressed to En Mahadzir, they are interconnected, as all of life is. And wherever possible, as the resident representative we are here to cooperate for the safety or our community. Nothing will move if every department keeps ping pong-ing the case from one to the other. But if each of us does a little, the job will feel lighter for everyone.  

So, as discussed with En Mahadzir, I have opened enquiries at JUPEM.000024 and Jabatan Tanah & Galian  JKPTG.000577 so that MBPJ staff have a case number to raise when they communicate and try to find more information with said agencies.  

It gives me no pleasure to potentially upheave the lives of my neighbours, however, it is important that we are not myopic in our actions especially when it relates to the safety of the community. Once again, buildings in this island pocket of the Bukit Gasing neighbourhood are old.  

KWSP Gasing at the back has burnt numerous times, and another house (2 Jalan 5/31) at the front, that was previously an illegal old folks home also had one fire casualty. Emergency passages are important. And I kindly remind you, we have 3 kindergartens, 1 primary school, 3-4 senior care homes that are immediately affected by the closed passage should there be, hopefully never ever, an emergency one day. 

Question 3 - What are the building codes and legislations that permit JUPEM to classify what was previously parit kerajaan MBPJ as private land? 

Moving forward, as the complainant, I seek from MBPJ the relevant building codes & legislation that permit JUPEM's mapping of houses #2 & #4 boundaries' over the parit kerajaan. If there is evidence to support that it is legal and safe, then I guess we do not have a case. 

I look forward to the update and answers to the above 3 questions, to begin with, and please let me know how else I might be able to support resolving this safety matter.
