Reopen the case and return my children

The Issue

In the heart of a family, the unjust separation from one's children is a wound that never heals. This is the painful reality that I've been living with regarding my three precious children, who were wrongfully removed from my care. Despite my tireless efforts and relentless pursuit of justice, the system seems to have failed us at every turn.

I'm calling for the immediate reopening of the case concerning my children's removal and demand a thorough review and the return of my children. Central to this cause is the need for transparency and accountability from Child Protective Services (CPS) and the Department of Social Services (DSS). It's crucial that all records, actions, and decisions, particularly concerning my children's welfare and foster care placement, be fully disclosed. We demand the examination of these records to discern the truth and highlight any oversights or misconduct. the return of both my sons  bc my daughter was returned after the judge terminated dss from her care with no neglect findings   my son case reopened and facts brought to light and have him returned as well as my son miles floyd jr  for false allegations that i neglected him when he has never been in my care or custiody at any giving time

Moreover, the review of medical records and foster placement actions is imperative to ensure compliance with established protocols aimed at the children’s welfare. This review will shed light on whether the necessary and reasonable reunification efforts were genuinely made, as prescribed by the legal framework.

Additionally, transcripts of the court hearings and all communication between DSS, fosters, daycare, and any involved parties must be scrutinized to identify any judicial misconduct or threats that compromised justice and fairness. It is not just my family calling for this review, but countless others who have faced similar injustices.

Every child deserves to be with a loving family. Families should not be torn apart without exhaustive efforts to keep them together. I urge you all to support this cause and push for a re-evaluation that prioritizes justice, integrity, and family unity.

PUBLIC STATEMENT REGARDING MY CHILD CUSTODY CASE
My name is Miles Floyd. I am the father of Carter M. Rogers (DOB: April 19, 2020). I am issuing this statement to explain what has occurred in my custody case so that people understand my situation directly from me.

 
1. REMOVAL OF MY SON
My son was removed from my custody on or around January 7, 2021. I believe this removal was not properly justified and was based on allegations that were never proven in court with reliable evidence. they said i violated a order of protection but i wa never served untill he was placed in a foster home county attorney from broome county showed up at a family court hearing in tioga county and said haha we alreadys have ur son ur never getting him back and the baby u have on the way were taking that one to and any baby u have by time we get done with u youll be stuck in a 4x4 they did everything he threatend he did this at a court hearing fopr carter rogers and they did 3 weeks later have security  lock me and the mother outta the hosiptol  from are new born with no court order and no cys worker present  her name is skylynn floyd and they wrote striongs hosiptol  telling them not to let us in or give us info when are daughter needed us most

e facts of my case demand attention:

A Proven Parent: A judge has already returned my daughter to my care, finding no evidence of neglect. This proves I am a capable father, yet my sons remain separated from me.
False Allegations: My son, Miles Floyd Jr., was removed based on allegations of neglect despite never having been in my physical custody at the time of the claim.
Lack of Due Process: I was never served with the alleged Order of Protection until after my son was placed in foster care.

 
2. MY EFFORTS AS A PARENT
After removal, I complied with all services required of me, including parenting programs, evaluations, and court-ordered requirements.

I was also granted a long period of visitation, including more than a year of unsupervised visits with my son, during which there were no findings that I was unsafe or unfit to parent.

 
3. LOSS OF CONTACT AND RESTRICTIONS
Later, my visitation and contact were reduced or stopped. I was also blocked from meaningful participation in my son’s life, including:

School involvement
Daycare communication
Medical appointments
Direct communication with foster placement
 
4. CONCERNS ABOUT HOW THE CASE WAS HANDLED
I have serious concerns about how this case was handled, including:

Claims made about my newborn daughter that medical records later contradicted
My daughter later becoming severely ill and requiring major surgery after being in state care
Statements and actions that suggest bias toward foster placement over reunification
Reports in medical records where a foster parent was identified in a way that created confusion about parental identity
 
5. LEGAL OUTCOME
My parental rights to my son were ultimately terminated. I am currently challenging how that decision was made and whether proper procedures, fairness, and reunification efforts were fully followed.

 
6. MY POSITION
I am not sharing this to attack individuals or agencies. I am sharing this because I believe:

My rights as a parent were not fully respected
Important facts were not properly considered
My relationship with my child was not treated fairly under the law
My goal is to seek review of the case and fairness in how these decisions were made.

 
7. CLOSING
I remain committed to my children and to doing whatever is necessary to be part of their lives in a safe and lawful way.
