Subject: Renewed Petition Opposing the Bail Application of Ntombi Susan Nxumalo
We, the undersigned members of the KwaTsaDuza community, together with civil society organisations and advocates against Gender-Based Violence and Femicide (GBVF), respectfully submit this renewed petition to oppose the latest bail application brought by the accused, Ntombi Susan Nxumalo.
We have been informed that the accused has submitted a further application for bail. While we respect the accused's constitutional rights and the authority of this Honourable Court, we respectfully submit that the interests of justice continue to favour the accused remaining in custody pending the finalisation of this matter.
Grounds for Opposing Bail
The allegations before the Court involve a serious and violent offence that resulted in the loss of Lizzy Ntonjana Mashaba's life.
The family of the deceased and the KwaTsaDuza community continue to experience fear, trauma, and emotional distress arising from this matter.
The release of the accused may create fear among potential witnesses and may undermine public confidence in the administration of justice.
South Africa continues to face a devastating crisis of Gender-Based Violence and Femicide. Communities look to the justice system to carefully consider public safety and the protection of victims and witnesses when determining bail in serious violent cases.
While we acknowledge that the accused has reportedly raised health concerns in support of this application, we respectfully submit that these concerns should be considered together with all other legal factors governing bail, including the seriousness of the allegations, the interests of justice, community safety, and the integrity of the judicial process.
Our Respectful Request to the Honourable Court
We respectfully request that the Court refuse the renewed bail application and allow the criminal proceedings to continue without compromising public confidence, community safety, or the interests of justice.
This petition is not intended to interfere with the independence of the Court. Rather, it reflects the collective voice of a community exercising its constitutional right to participate peacefully in matters affecting justice, safety, and the protection of human dignity.
We remain committed to respecting the rule of law and will continue to support the Mashaba family through peaceful and lawful advocacy.
