The Issue
PETITION: Remove the 2-Year Time Limit for Military Medical Malpractice Claims by Veterans
To: The United States Congress, Department of Defense, and All State Legislatures
We, the undersigned veterans and citizens, demand the immediate elimination of all statutes of limitations that prevent former military members from filing lawsuits against the military and federal government for medical malpractice and related harms.
WHEREAS:
The current Feres Doctrine and Stayskal Act impose an unjust
year deadline to file administrative claims for military medical malpractice. Medical staff within the military system routinely complicate diagnoses, withhold records, and mislead injured service members, making it impossible for many to discover the full extent of their injuries within 2 years.
The current state of the government is in the hands of a complete imbecile who forces his employees to disregard many potential winning lawsuits. This political interference denies veterans due process and shields negligent government actors from accountability.
In the current political state that we're in right now, many of us have had to suffer against sexism, racism, and homophobia within the military medical system. These systemic abuses are often covered up and take years to uncover, meaning the 2-year limit silences the very people most harmed.
THEREFORE, WE DEMAND:
Congress shall pass legislation removing ALL time limits for veterans filing medical malpractice, negligence, and civil rights claims against the Department of Defense, military hospitals, and the United States government.
No state in the U.S. shall enforce a statute of limitations that prevents former military members from suing the government and the military as a whole for harm incurred during service.
All previously time-barred claims shall be reopened, allowing veterans who were denied justice by arbitrary deadlines to have their day in court.
Veterans risked their lives for this country. The government's negligence, cover-ups, and political dysfunction should not be rewarded with immunity based on a clock. Justice delayed by bureaucracy and bigotry is justice denied.
