PETITION FOR THE REMOVAL OF SFISO AND THAKGI AS HOSTS OF "PODCAST AND CHILL" OR THE CESSATION OF THE PLATFORMTo the Management and Stakeholders of "Podcast and Chill":We, on behalf of concerned citizens, victims of cyberbullying, and advocates for mental health and online safety, hereby submit this formal petition demanding immediate action against the hosts Sfiso and Thakgi for their repeated engagement in harmful conduct on social media platforms. This petition is grounded in principles of accountability, ethical broadcasting, and the protection of vulnerable individuals from psychological harm, as enshrined in applicable laws including but not limited to the South African Constitution's guarantees of dignity and freedom from harm, the Cybercrimes Act 19 of 2020, and international standards on digital harassment.Statement of Facts:Sfiso and Thakgi, in their capacities as hosts of "Podcast and Chill," have systematically engaged in bullying behavior targeting individuals based on their physical appearance. Such actions constitute cyberbullying, which is defined under South African law as the use of electronic communication to harass, intimidate, or cause emotional distress to another person.
Recent incidents include derogatory comments directed at Thatohatsi, which have been widely disseminated on social media. These comments, characterized by body-shaming and personal ridicule, have directly contributed to severe psychological repercussions for the victim, including suicidal ideation. Medical and testimonial evidence supports the causal link between such targeted harassment and deteriorating mental health, potentially amounting to actionable harm under tort law principles of negligence and intentional infliction of emotional distress.
As public figures associated with "Podcast and Chill," Sfiso and Thakgi's conduct not only reflects poorly on the platform but also amplifies the reach and impact of their bullying, fostering a toxic environment that endangers public welfare. The platform's failure to address these behaviors may expose it to vicarious liability for facilitating or endorsing harmful content.
Demands:In light of the foregoing, we demand the following remedial actions within fourteen (14) days of receipt of this petition:a. The immediate removal of Sfiso and Thakgi from their roles as hosts of "Podcast and Chill," including the suspension of any associated broadcasting privileges.b. In the alternative, should removal not be feasible or sufficient to mitigate ongoing harm, the complete cessation and shutdown of the "Podcast and Chill" platform to prevent further dissemination of injurious content.c. A public apology issued by the platform to Thatohatsi and all affected individuals, coupled with a commitment to implement robust anti-bullying policies, including mandatory training for hosts and content moderators on ethical communication and mental health awareness.Failure to comply with these demands may necessitate escalation.This petition is submitted in the public interest and with the intent to promote a safer digital space.
