Remove Parts 42/43 in NYC Civil Court, Kings County
The Issue
This Petition will not be submitted unless we receive at least 50 signatures
We, the Attorneys appearing in the no-fault motion parts of Civil Kings, hereby request the elimination of Part 42 and Part 43.
The recent scheduling of Parts 42/43 in the NYC Civil Court, Kings County, has led to a significant burden on the No-Fault Bar of Kings County. Attorneys have had to double their appearing staff almost overnight due to conflicting schedules, as Parts 42/43 are now set for virtual appearances at 11 am on Mondays, Wednesdays, and Thursdays—the same time as Parts 40/41. This sudden change has created logistical chaos and increased stress on the legal professionals involved.
Additionally, major administrative issues have arisen in the roll out of the new Parts. Motions are being placed on the Court Calendar sometimes with less than 24 hours notice, or less than 2 business hour notice. All while the original motion Parts 40/41 proceed as usual, but with just a third (1/3) of the volume of two years ago. This has caused unnecessary defaults on first time on motions.
A survey was sent to the Kings no-fault practitioners on Friday April 24, 2026. Attorneys voted overwhelmingly in favor of eliminating Parts 42/43. Survey results: https://www.surveymonkey.com/results/SM-t1ZStiBtM5RBEz8KN3AOiQ_3D_3D/
By making this change, the Court would demonstrate its commitment to efficiency and consideration for the professionals who uphold the law every day, and ensure that all legal proceedings can continue smoothly without unnecessary delays or logistical problems.
In the alternative, we request an adjustment of the appearance times for Parts 42/43 to a non-conflicting slot, so that the calls do not occur simultaneously. This alteration would provide a more manageable schedule for attorneys, assuming the calendaring challenges are also resolved.
