Remove L&T as the main service provider for handling and maintaining the MCA Website!
Why this petition matters
There have always been various technical issues in the Ministry of Corporate Affairs website over the many years that it has been functional. However, all those glitches pale in comparison to the downright terrible maintenance of the MCA website ever since the introduction of the 'V3' portal of the MCA website exclusively for LLPs. This version was planned to be launched in March 2022 with a promise to make the LLP filings completely Web Based and simpler to use. Various stakeholders had received information to stop using the V2 portal and plan activities surrounding the LLP filings accordingly. To begin with, there was absolutely no need to even bring about this change as the V2 LLP portal was working seamlessly before this introduction. Every service related to LLP filing beginning with incorporation to filing Annual Returns was a very smooth ordeal in V2.
However, since the introduction of this new V3 portal, every single form and every single filing pertaining to LLP's has gone haywire. Incorporation of LLP's was and still continues to be nothing sort of a nightmare for professionals like CAs, CS's CMA's across the country. For more than 2 months since the introduction of the portal, all the LLP forms simply went missing. Yes, the forms simply went missing with no trace of the work that was done anywhere to be found. Many a times, we were not even able to login throughout the day. There was absolutely nothing we could do except stare at the screen in confusion.
As usual, the only way any grievance can be redressed for errors occurring on the MCA website was to call Helpdesk, raise a ticket or send an email to certain email ID's. Phone calls to Helpdesk were frustrating. The only response for queries relating the new portal for over 2 long months (March and April) were 'There are technical issues. Our back-end team is working on the same and we are not authorised to say anything else'. Despite raising countless tickets and sending countless emails, none of our grievances were solved. It almost became a daily routine to raise tickets every day instead of getting actual work done in the LLP portal. It is shocking to know that there is no other way to redress grievance of stakeholders for a country as large as India. Sometime around the middle of May, (almost 3 months after the introduction) the portal did indeed start working fine for some time much to our surprise. We were finally able to file some forms once in a few days. However, the technical issues we face on a daily basis are still so vast in number and the grievances professionals face are going unanswered as before. We are being forced to deal with newer and unrelated errors especially in the field of LLP Incorporation.
It was also confusing for us to look at false statements on the MCA website homepage that was stating that many thousands of forms had been filed since the introduction of V3 portal in March 2022 whereas in reality, the portal was partly working only sometime around the middle of May. It was very confusing indeed. It showed that no one from the technical team of L&T was ready to take the responsibility of the grave errors and technical malfunctioning of the MCA website which was causing so much hardships to stakeholders across the country.
The Hon'ble High Court and Supreme court had pulled up Infosys (which is managing the GSTN and Income Tax portal too) many number of times for putting tax payers and other stakeholders at terrible inconvenience because of the lackadaisical manner in which government portals are maintained by them. However despite all the grievances raised by the stakeholders from all quarters, we do not see any efforts to set right the grave errors in the MCA portal to make it workable. It is downright atrocious to know that it has taken literally half a year to change the user interface and the user interface is still behaving haywire.
For example, at the time of resubmission of an incorporation form, we are facing errors that the 'Name validity of the LLP has expired'. One wonders how this is even possible when we were able to file the FiLLip form in the first place and this is merely a resubmission! Even the spelling of the word 'Errors' in the display message is wrong (as evidenced in the photo). It reads as 'Erros' Such is the quality of service being provided by the esteemed team of L&T.
It is also shocking to note that the particulars of the 'Date of last financial year end date for which Statement of Accounts and Solvency filed'
and 'Date of last financial year end date for which Annual Return filed'
of all LLP's in the MCA Website states 'NIL'. The Master Data has become so misleading to read to any new entrant to the Indian Corporate Sector who would only assume that no returns were filed for any LLP in the country all these years. (Even the Master data of the LLP in which Shri Mukesh Ambani is a DP shows the same status sadly.)
And now, even the V2 portal pertaining to Companies is full of errors and glitches. Many professionals have complained that they are getting arbitrary errors when it comes to filing Spice+ forms for incorporation of Company. There have been instances where forms have come back for resubmission without any remarks and there is no way whatsoever to resubmit such a form.
There are still many other unresolved technical errors faced by professionals across the country which remain unanswered since no one is taking responsibility for the technical glitches of the website. Professionals are investing almost 80% of their time and efforts on mundane tasks every day like raising tickets, making calls to the helpdesk only to be turned down and end up facing embarrassment from clients eventually. This time could better be utilized towards providing quality service.
We all wish to bring attention to this issue and make a petition to have L&T removed as the main service provider for handling the MCA website. Please remove L&T and hand over this work to some other capable team so that the image of the Corporate Sector of India is not tarnished anymore. L&T should be removed. Better quality of service and grievance redressal should be provided to all the stakeholders who are suffering since the introduction of this V3 portal.
