Remove Brenda Upton From the Wyoming State Board of Pharmacy
The Issue
Wyoming State Board of Pharmacy President Brenda Upton has shown unprofessional conduct towards the public. She denied public comment at the BOP meeting on September 18th, 2024. Public comment was removed from the boards agenda, the day prior to the meeting due to the large public interest. The Board had ordered a summary suspension of City Drugs pharmacy license on September 12th at a meeting closed to the public.
Brenda Upton who was leading the meeting and denied public comment at a public meeting. Brenda had an elitist attitude towards the public. She laughed and snickered when the public tried to let their voice be heard. Her opinion was that "the public safety and welfare are at risk and immediate action is required" regardless of no patient ever being hurt by the pharmacy and many patients lives depending on the pharmacy. Brenda believed that she knew better than the Cheyenne public about their health and that their opinion or voice did not matter.
33-24-102. States that there shall be a Wyoming State Board of Pharmacy and the 9 members "shall be appointed by the governor, by and with the advice and consent of the senate."
33-24-111. Report to governor. The board shall, as required by W.S. 9-2-1014, report to the governor relative to its proceedings.
33-24-107. State board of pharmacy; removal of members. The governor may remove any member as provided in W.S. 9-1-202.
9-1-202. Removal of appointive officers and commissioners; reason for removal to be filed.
(a) Notwithstanding any other provision of law and except as otherwise provided in this section, any person may be removed by the governor, at the governor's pleasure,
(b) (ii) The governor, for malfeasance or misconduct in office.
5 of the current 8 board members, have been appointed by Governor Gordon. Brenda Upton was not appointed by Governor Gordon however she is giving the executive branch of the Wyoming State government a poor image and ignoring the public whom she is claiming to protect.
It is the request of the public and medical professionals that Governor Gordon use Title 9-1-102 to remove Brenda Upton from her position on the Wyoming State Board of Pharmacy. There are many pharmacists throughout the state who show care and compassion for their communities who would be better suited to this role to advance the pharmacy profession.
