Release Wrongfully Convicted Gavin Thomas

The Issue

Imagine facing the harsh reality of being wrongfully convicted while knowing that you are innocent. This is the unfortunate situation for Gavin Thomas in Albany County who is standing up to challenge his conviction through a habeas corpus petition. New York State justice system continues to keep him in prison and challenge every appeal he submits. Gavin has been fighting for justice since 2014 after receiving ineffective legal counsel, a tragic oversight that contributed to this miscarriage of justice. He is serving 15 years for Criminal possession of a weapon in the 2nd degree after Albany Police found a gun in a residence unrelated to Thomas. Furthermore; Thomas was in police custody for five (5) hours for tinted windows and did not have a gun on his persons when he was charged.

He thought truth and justice was at the front of everything, and it certainly has not been in Thomas case. His journey through the legal system has been fraught with obstacles. During his trial, his legal counsel failed to disclose a glaring conflict of interest about her business relationship with the DA. Shockingly, or not his defense counsel was paying the prosecuting DA to draft appellate briefs for her firm. Thomas prosecution was led by ex Albany County Assistant District Attorney, Steven Sharp who admitted drafting numerous criminal briefs for Thomas counsel as a side job. Such a conflict raised serious ethical concerns and undeniably tainted the integrity of the trial process.

Furthermore, Katheryn Conklin-Mabey defense counsel's failed to call crucial witnesses and thoroughly investigate/challenge the unquestionable evidence of his innocence. In furtherance, Conklin-Mabey did not challenge the alleged complainant, nor did she challenge the probable cause behind the charges that was left with substantial gaps in this case.  Here, in this case Thomas was not afforded the opportunity to face his alleged accuser, highlighting the over-reliance on law enforcement testimony without corroborating evidence, further solidifying this egregious miscarriage of justice. Furthermore, Thomas indictment is a fraud. Ex-ADA Steven Sharp used Isaiah Anderson grand jury testimony against Thomas to secure a conviction as evidence by Thomas sentencing minutes. 

The implications of Gavin Thomas wrongful conviction are profound, not just for him, but for the entire Albany community. It underscores the potential for systemic failures to strip innocent individuals of their freedom and rights. It is vital that we advocate for a fair review of Thomas’ habeas corpus petition, ensuring all evidence is thoroughly examined and justice is duly served.
