 We call upon the government of Tamilnadu to end his arbitrary detention immediately and unconditionally.

Activist Thirumugan Gandhi has instructed a team of expert lawyers to challenge his continued detention by the state of Tamilnadu. Thirumurugan, a citizen of India has been detained in Vellore central prison in Tamilnadu on the charge of sedition from  9th August 2018.  

This week, Mr. Thirumurugan Gandhi's legal team, along with the organizations' People's Watch and several other Non-governmental organizations, have filed urgent appeals with the United Nations Working Group on Arbitrary Detention.

The appeals request urgent steps to protect Mr. Thirumurugan Gandhi and to call on the authorities in India to comply with their international legal obligations.

These urgent appeals have been filed after the Chief Minister of Tamilnadu Mr.Edapaddi K Palaniswami, failed to respond to urgent open letters and statements calling for Mr. Gandhi's immediate and unconditional release,  by a large number of Lawmakers, Artists, Writers, and Civil society leaders.

Thirumurugan Gandhi

Thirumurugan Gandhi is the coordinator of the "May 17 movement". As part of the movement,  he consistently advocates for the democratic aspirations of Eelam Tamils, Palestinians, Kurds, Kashmiris, Western Saharans and Sikhs, he also regularly lobbies with the diplomats of the global south to realize the interests of the nations without state power, indigenous people groups and communities which have faced war crimes committed by the global powers at the Geneva human rights sessions of the United Nations (UN) for the past three years. He has represented Tamil civil society in Permanent people’s Tribunal for Srilanka in Dublin and Ireland (2010 and 2013). To introduce Permanent people’s tribunal, it is an opinion tribunal whose activities include identifying and publicizing cases of systematic violation of fundamental rights, especially cases in which national and international legislation failed to defend the rights of the people. He has also been in the forefront to call for the justice during the custodial murder of migrant laborers,asserting water rights of the farmers , campaigning and protesting for worker rights ,refugee rights, disability rights , campaigns against death penalty, fighting for the rights of the linguistic and religious minorities, Tribal rights, Transgender rights and have been active in protesting against new WTO rules pertaining to public distribution system, privatization of electricity , Eco-sensitive projects like hydraulic fracturing, and against commissioning of Nuclear reactors in dense populations.

His organization “May 17 movement” stood firm in opposing the Free market-Hindu fundamentalist policies of the Modi Government from day one. He is also a frequent participant in television debates pertaining to the issues mentioned above in regional and national media. His Strong Convictions and uncompromising attitude in standing for the weak have unsettled many powerful people and groups in India. One of the many reasons, he is being hounded now

Thirumurugan Gandhi is a well known human right's activist and an independent representative from India at the United Nations Human Rights Council. For many years, he has been a critic of the Prime minister Narendra Modi's regime and the chief minister  Mr.Edapaddi K Palaniswami's regime. His work continues to get national recognition and he is a recipient of multiple awards.

Last year, he was arrested under the draconian "The Goondas Act", a preventive detention law for more than hundred days, the apex court of the state quashed the legal charges. He was not compensated for the mental agony and deprivation despite the UNHRC official's recommendations to the Indian authorities to do the same.

On 9th August 2018, after his representation at the 38th session of the  Human Rights Council for the victims of the police killings and the torture during the recent protest against the proposed expansion of the Sterlite Industries a subsidiary of the Vedanta Resources plc  a global diversified metals and mining company with its headquarters in London, United Kingdom. It is the largest mining and non-ferrous metals company in India and has mining operations in Australia and Zambia


Mr.Thirumurugan Gandhi was detained by the airport authorities at the Bengaluru airport on 9th August 2018 after a lookout notice was issued by the Tamilnadu Police throughout the country, He was subsequently taken under the custody of the TN police under charges of Cybercrime for the circulation of the speech representing as an Independent representative at United Nation Human Rights Council (UNHRC), Geneva, Switzerland. The arrest happened while he was returning back from Europe to Bengaluru. The police continued to cause mental distress and deprived him of food on the way back from Bengaluru to Chennai.

After the Judicial magistrate reprimanded the police officials for detaining him on flimsy charges and refused to hold him under judicial custody, Mr.Thirumurugan Gandhi was released on 10th August 2018. However, the police detained him again with sedition charge for garlanding the statue of the social reformer " Periyar". He was taken to the Puzhal central prison but without notifying the concerned person, he was mysteriously transferred to the Vellore central prison.

Restrictions on Free Speech and Assembly in India

Freedom of Speech and Assembly is severely curtailed in India. On 19th June 2018, police arrested the Student activist Valarmathi, two weeks after the arrest of Mr.Velmurugan, a former member of the legislative assembly. Both the activists were detained for many days. The opposition to projects which harms the livelihood of farmers, fisherfolks, and small-scale industries faces the severe crackdown. In May Police murdered 13 citizens including the school student Ms.Snowlin and tortured hundreds of citizens for opposing the proposed expansion of the copper smelting plant in Thoothukudi.

The police officials responsible for the murder and torture continue to function with impunity and the human rights activists like Thirumurugan Gandhi who expose the abuses in the International forum faces sedition charges.

Urgent Appeal

Mr. Thirumurugan Gandhi has instructed his expert legal team and his political associates to take action. Their urgent appeals set out the infringements by Government of India and state of Tamilnadu of its international obligations both to protect Mr. Thirumurugan Gandhi's right to freedom of opinion and expression and that his arbitrary detention with continuous harassment is neither necessary or reasonable

We urge the government authorities to ensure the physical and moral integrity of Thirumugan Gandhi.

We ask you to write to the Indian authorities, Indian diplomatic representatives and to the Ministry of Foreign Affairs in your respective countries to draw their attention to your concerns and forward them this statement
