The Issue
Anthony Dustin McMillan is living a delicate situation that risks his mental health well-being, as well as his family's. Please read, and help; use the links provided to contact officials listed in this petition every day, please.
Anthony has been incarcerated since he was 19, in 2001, serving a 31 year sentence for Robbery and Breaking and Entering.
On June 2nd, 2024, Anthony received a life-altering announcement from the VADOC, informing him that his release from prison was being moved to July 1st, 2024. On June 27th, 2024, Anthony was informed that a mistake was made, that he was not being released until September 20th, 2027.
This puzzling and distressing change in sentence took him from expecting his release within a month, to a longer wait until September, 2027.
Anthony has spent already 23 years in prison for robbery and breaking and entering. His family was eagerly awaiting his return in 2028; however, in early June of 2024, VADOC used the new good time law, 53.1-202.3, to give Anthony an early release date for good behavior, set for July 1st, 2024.
This news was a blessing to everyone, Anthony's family began preparing for his homecoming, even the Rockingham Country Probation office has informed Anthony's mother of the good news. One June 27th, when Anthony had to inform his family that he was not coming home July 1st, this news crushed the hopes of a bright reunification for him and his family.
Anthony's mother is ailing, and their home is in dire need of repairs she cannot manage on her own. His uncle is a regular patient for dialysis treatments, requiring regular assistance, and asks daily why hasn't Anthony come to visit him as he thought Anthony was released.
Given his lengthy sentence, Mr. McMillan has been able to reflect and ideate several business and program proposals aimed at helping those in need, which he is eager to start once he regains his freedom. Delaying his release not only affects his family's well-being but potentially deprives the community of these viable community projects.
It's time for us to shine the light of justice on this situation. By signing this petition, we can voice our demand to that the Virginia Department of Corrections should not be allowed to put anyone, incarcerated, or free, through sadistic and malicious mental anguish. You can help Anthony McMillan find relief through recommendation of comuted sentence, granting a relief if the emotional hardships placed by knowledge of the false release date they had given. In March of 2024, Anthony's petition for clemency was turned down by Governor Youngkins administration. However, you can write, email, and call the Governor to ask that Anthony be shown mercy by reconsidering Anthony's clemency, and granting him a sentence communication to be released on house arrest or probation.
Remember, Prison is supposed to rehabilitate and protect society from dangerous people; Anthony has received 23 years of rehabilitation, has skills and vision to become a positive productive member of the community, and is not considered a threat to society based on annual reviews and a good time law that was mistakenly applied.
