Rejection of Delta Dental Letter - Colorado Dentists
The Issue
I am writing on behalf of the dentists of the State of Colorado to object to the recent Delta Dental letter in its entirety.
Firstly, the letters were not sent via certified mail, which has resulted in many participating dentists not receiving or being aware of the letter. This lack of proper notification is preventing all dentists' voices from being heard. It is also unreasonable to expect dentists to inherently agree to all the terms in your letter without obtaining proper signatures confirming said terms.
Secondly, a fifteen-day turnaround is insufficient for obtaining outside expertise or review by legal counsel. It is crucial to emphasize that it took over a week for Delta Dental to respond to the CDA in an attempt to clarify the content of the letter. Even then, the clarification failed to define what "de minimis" means. If Delta Dental cannot clearly define the terms of their letter within two weeks, it is unreasonable to expect dentists to respond within such a short timeframe. We will not agree to any terms without adequate time for a full legal review.
Furthermore, the term "de minimis" is vague and misleading. We reject any implication that Delta Dental fees are reasonable or acceptable. This language is deceptive and could have serious implications for any dental loss ratio legislation.
This letter serves as an unequivocal rejection of your letter in its entirety. The dentists of Colorado deserve better from Delta Dental.
