Reform Title IV-D process for a Fairer Implementation

The Issue

Drawing from a deeply personal experience, myself like millions of American families have suffered the unjust impacts of Title IV-D laws and its administrative process. Taken to task by an undeserving, devastating trajectory that saw the some parents and states profiting at the expense of our family integrity. 

Our plea centers around the holistic reformation of Title IV-D administrative processes with several key points:

1. Applicants should provide concrete evidence of neglect, thereby promoting responsible application and discouraging potential misuse.
2. Title IV-D’s scope should be limited to only those who are either dependent on public assistance or are at a clear risk, ensuring resources prioritize those in genuine dire need.
3. Accountability of funds usage must be a requisite aspect, thus steering away from potential financial exploitation.
4. Applicants ought to disclose their income, promoting transparency and making it possible to allocate resources justly. There should be a reasonable cap considering cost of living in custodial area.
5. States must safeguard the inalienable constitutional right of every defendant to due process. The current status quo fundamentally contradicts with the principles laid out in the U.S. Constitution. Additionally, the U.S. Constitution, in Article I, Section 9, restricts Congress from passing "bills of attainder"(laws that impose punishment without trial) and "ex post facto laws" (laws that punish individuals retroactively). While these sections don't directly address debt, they reflect a broader principle of protection against punitive measures without due process.
6. Lastly, private enforcement agencies backed by the state should not be given the authority to make decisions in private matters, as it compromises the autonomy and wellbeing of families like ours.
