Reform the Florida Baker Act procedures

The Issue

Many individuals today struggle with anxiety and depression, yet when they seek help, they're often treated like criminals. This is a reality I've experienced firsthand and it must change. Imagine needing support, only to find yourself in handcuffs, terrified and treated as if you're under arrest.

In Florida, the Baker Act is meant to provide critical assistance to those in mental health crises but its execution by law enforcement often leads to misunderstandings and wrongful stigmatization. When a well-being check or a 911 call is made, law enforcement should be 100% certain of the legitimacy and necessity of the intervention before determining that an individual meets the criteria for involuntary examination and committing them to a mental health facility like Meridian Healthcare in North Central Florida. Too often, these interventions are based on incomplete or inaccurate call logs, bypassing essential considerations of human dignity and respect.

We are calling for a comprehensive reform of the Florida Baker Act to ensure proper training for law enforcement in dealing with mental health crises. Officers should be trained to assess situations with empathy and understanding, distinguishing between true emergencies and situations that could be handled with less aggressive interventions. This involves scrutinizing the accuracy of call logs and providing individuals the respect and dignity they deserve. Moreover, individuals should have the right to choose a safe space for themselves during such evaluations, preventing the trauma associated with being forcibly taken to facilities.

Reforming these procedures not only protects the rights of those facing mental health challenges but also encourages a more compassionate response from our community. Establishing strict laws and protocols will prevent misuse and foster trust in the system designed to protect us.
