Reform the Digital Millennium Copyright Act to Protect Individual Creators

The Issue

I am a creator, and like many others, I have experienced firsthand the abuse of power by corporations under the Digital Millennium Copyright Act (DMCA). My personal projects were removed from GitHub because Nintendo, a $58 billion company, did not approve of my creative direction. This is not an isolated incident - it's practically a meme at this point. The DMCA currently lacks protections for individuals like me and heavily favors large corporations.

The DMCA was enacted in 1998 to address copyright issues that arose due to the digital age. However, its provisions are now frequently abused by big companies to stifle competition and control creativity. According to a study by Columbia Law School, over 50% of DMCA takedown notices received by Google were sent without proper consideration of fair use or even whether copyright infringement had occurred (Urban & Quilter).

This imbalance needs rectification. We need reforms that protect individual creators from arbitrary takedowns and provide them with feasible avenues for dispute resolution against powerful entities.
