Subject: Enactment of State-Level Criminal Justice Reform Modeled After the Federal First Step Act
We, the undersigned, urge the Legislature and Governor Kathy Hochul to take immediate action in enacting meaningful criminal justice reform to provide relief for nonviolent offenders and those eligible for parole, particularly in light of the ongoing New York State Corrections Officer strike, which has further exacerbated systemic challenges within our criminal justice system.
Modeled after the federal First Step Act, which was signed into law in 2018, we propose the following measures be implemented in New York State:
1. Expanded Earned Time Credits & Rehabilitation Programs
- Establish a system of earned time credits that allow nonviolent offenders to participate in rehabilitative and educational programs, thereby reducing their sentences in a structured and accountable manner.
- Increase funding for vocational training, mental health services, and drug treatment programs, ensuring incarcerated individuals have access to the resources necessary for successful reintegration into society.
2. Sentencing Reform for Nonviolent Offenders
- Reevaluate mandatory minimum sentencing laws for nonviolent drug and property crimes, allowing for judicial discretion and proportional sentencing.
- Implement retroactive sentencing reductions where appropriate, similar to the reforms enacted in the federal First Step Act.
3. Parole and Reentry Reform
- Expand parole eligibility and streamline the parole review process for individuals demonstrating rehabilitation and readiness to return to society.
- Reduce technical parole violations that lead to re-incarceration, prioritizing rehabilitation and community supervision over punitive measures.
- Establish reentry initiatives, including job placement programs, housing assistance, and mental health support, to lower recidivism rates and improve community reintegration.
4. Compassionate Release for Elderly and Terminally Ill Inmates
- Develop a compassionate release framework for incarcerated individuals who are elderly, terminally ill, or have served a substantial portion of their sentences and pose no public safety risk.
- Provide alternative supervision methods, such as home confinement, for individuals who meet eligibility criteria.
The Urgent Need for Reform Amid the Corrections Officer Strike
The ongoing strike by New York State Corrections Officers underscores the unsustainable conditions within our prison system, further emphasizing the urgent need for reform. Overcrowded facilities, understaffing, and a punitive rather than rehabilitative approach have contributed to escalating tensions and inefficiencies within the system.
By enacting these reforms, New York can alleviate the strain on correctional institutions, prioritize public safety through targeted rehabilitation efforts, and uphold the principles of justice and fairness for those who have demonstrated their capacity for change.
We urge you to take swift legislative action to pass these reforms and ensure that New York leads the nation in responsible, compassionate, and effective criminal justice policies.
