Reform Legislation for DCJ & Children's Court
The issue
unfortunately Like many Australians I am an individual who has experienced first-hand the potential shortfalls of our current judicial system, specifically regarding the Department of Communities and Justice (DCJ) and the children's court. I was its unfortunate victim of false accusations, to which no relevant evidence was sought, leading to unmerited suffering and distress It doesn’t only effect me but it effects my children and it effects all the families of Australia and their children who have suffered under the same circumstances.
We have a system that, in its attempts to protect and ensure justice, simultaneously has the potential to fail those it seeks to protect. Errors made by DCJ and blind spots in the decision-making process allowed misinformation to proliferate and led to decisions made on skewed perceptions rather than established facts. The result of these flaws can be devastating for individuals and families alike.
In 2015, NSW Ombudsman published a report indicating that 42% of investigated complaints about DCJ related to child protection were upheld. This is a staggering number that screams for reform and improvement of the current system (source: NSW Ombudsman Report, 2015). In a society that prioritizes fairness and justice, such discrepancies and shortcomings are not acceptable.
Our campaign calls for reform in the legislation that governs DCJ and children's court operations, promoting a more stringent evidentiary requirement and preventing unjust decisions based on flawed or incomplete information. The amendment should include protocols for dealing with allegations and tighter monitoring measures to catch mistakes swiftly without leading to undue harm to innocent parties.
