Reform ICBC Policy and BC Vehicle Act Regarding Wage Loss Coverage
The Issue
The Insurance Corporation of British Columbia (ICBC) is a mandatory provincial insurer for all registered vehicles in BC. While ICBC provides essential insurance coverage, a concerning BC law forces accident victims to exhaust their employment sick days before they can access wage loss coverage. This petition calls for a change to this unfair legislation.
Being involved in an accident is a stressful and disruptive experience. Injuries can leave victims unable to work, causing financial hardship on top of the physical and emotional challenges of recovery. Under BC’s current law and ICBC's policy, victims are required to deplete their valuable sick days, leaving them vulnerable in the event of future illness or accidents. An ICBC Senior Support & Recovery Specialist states: “based on section 122 of the Insurance Vehicle Act and section 18 of the Enhanced Accident Benefit Regulations, ICBC is not required to reimburse or otherwise pay for the use of bank sick time.” This policy places unnecessary burdens on injured individuals, including:
- Financial Hardship: Many individuals cannot afford to lose both their wages and sick leave, especially if they have limited sick days available. This forces them to choose between financial stability and proper recovery.
- Pressure to Return to Work Early: Accident victims may feel compelled to return to work before they have fully healed, which could delay recovery or even worsen their condition.
We call on the BC provincial government to amend the Insurance Vehicle Act and for ICBC to adopt a more compassionate and fair policy. Specifically, we urge the immediate provision of wage loss benefits following an accident, without the requirement to deplete sick days. This reform would allow victims to preserve their sick leave for future illnesses or injuries, offering them better financial and emotional security during their recovery.
