Reform Green Card Process for Parents of US Citizens

The Issue

Having witnessed several marriages where the immigrant spouse married solely for immigration status, only to reveal the true intentions after obtaining a green card or US citizenship, I am deeply concerned. This issue hits close to home, as I have seen this unfold within my own family, resulting in disrupted lives and broken trust. Many other individuals have shared similar experiences through online blogs, underscoring the widespread nature of this issue.

A significant problem lies in the pressure exerted by parents within certain communities, particularly in arranged marriages, to secure their futures by pushing their children into marriages with US citizens. This is particularly prevalent in Asian communities, where the ultimate goal is not a harmonious union but an expedited path to secure immigration status for the parents via their children’s new citizenship.

A potential solution is to amend the current process regarding the change of status and green card acquisition for parents of US citizens who obtained their citizenship through marriage. As it stands, these parents can immediately apply for a change of status once their child secures US citizenship. This scenario can be easily exploited. It would be more prudent to implement a mandatory waiting period, preferably five years, after the child’s citizenship is attained before the parents can apply for a green card.

This change would curb the exploitation of the immigration system by reducing fraudulent marriages, providing a buffer period that prioritizes genuine intentions. \nWe need to bring this issue to the forefront of policy discussions, as it represents a critical step towards immigration reform.
