I have seen firsthand how the current child support system in the United States negatively affects countless families. Currently I'm making efforts to help make changes to the way child support payments are calculated instead of allowing judicial abuse. Most states use the Income Shares Model, which often imposes undue financial strain on the non-custodial parent. This model operates on the premise that a child should receive the same proportion of parental income that they would have if the parents remained together. Under 42 U.S.C. § 667 requires states to choose of 3 guidelines and establish them. However, this frequently still results in unequal/unfair payments that do not align with the realities of modern living costs.

Consider the situation of a non-custodial parent who sees most of their income diverted to child support. Leaving them with an insufficient amount to meet their basic needs or maintain any semblance of financial stability. The pressure to fulfill these financial obligations or possibly become incarcerated, can lead to undue stress and can negatively impact the relationship between the parent and child. As well as hinder the parent’s ability to contribute positively to their child’s life. Also proven to affect the mental health of loved ones involved.

What is needed is a more equitable system—one that considers the cost of living within different regions as the primary factor in calculating child support obligations. Also the custodial parent should be required to show proof of their child based contributions and expenses. This approach would ensure that payments are more realistic and sustainable, allowing the non-custodial parent to maintain an adequate standard of living while still fulfilling their financial responsibilities toward their child.

Reforming this aspect of the U.S. Family Court system would require a concerted effort, starting with the acknowledgment of the disproportionate burden placed on many non-custodial parents under the current scheme. By moving to a cost-of-living based model, we can alleviate these pressures, promote a more fair distribution of financial commitments, and ultimately prioritize the well-being of both parent and child.
