Reform Alabama's Custody Law: End the McLendon Standard and Put Children First
The Issue
📢 Petition Overview:
Alabama's custody laws are outdated and harmful. The current legal standard — known as the McLendon standard — makes it nearly impossible for a non-custodial parent to protect a child from harmful, neglectful, or unstable environments, even when a better alternative exists.
Under McLendon, the law prioritizes the “status quo” over a child’s best interests, ignoring a parent's genuine concerns and — most importantly — the child’s voice.
I’m calling on Governor Kay Ivey, Representative Dale Strong, and the Alabama Legislature to modernize our custody laws to protect children, not just preserve custody for the sake of stability.

🧾 Why This Matters:
In my own case, I have faced:
Repeated denial of visitation, even with court orders in place.
A custodial parent under federal investigation for falsifying Social Security records and misusing my child’s auxiliary benefits.
Neglect of my child’s special education needs, by placing him in schools that refuse to honor his IEP.
I have provided:
A loving, stable home.
A school system that fully supports his disability and learning plan.
A nurturing environment where my son is thriving in extracurriculars, making friends, and building self-esteem.
Still, the McLendon standard has tied the court’s hands — because the law values continuity over a child's potential to thrive.

We are demanding that Alabama:
1. Repeal or revise the McLendon standard, so the best interest of the child becomes the central focus.
2. Give meaningful weight to the child’s voice, especially for children 12 and older.
3. Allow courts to consider custodial misconduct, such as interference with visitation or misuse of federal benefits, as grounds for review.
4. Embrace a modern, evidence-based standard, in line with the majority of states nationwide.
