The Issue

 Introduction:

 We, the undersigned, are petitioning the Government of India to officially recognize Attention-Deficit/Hyperactivity Disorder (ADHD) as a disability in adults under the law. ADHD is a neurodevelopmental disorder that affects millions of adults in India, making it difficult to concentrate, organize their work, and complete tasks. Despite the significant impact that adult ADHD can have on a person's life, it is not currently recognized as a disability in India.

Background: 

 ADHD is recognized as a disability in countries such as the United States, Canada, United Kingdom, Australia, Sweden, Norway, Denmark, Finland, New Zealand, Netherlands, Ireland, Germany, France, Belgium, Austria, Switzerland, Italy, and Spain. Under the Americans with Disabilities Act (ADA) and other disability laws, individuals with ADHD are entitled to accommodations and protections to help them overcome the challenges associated with the condition. In India, however, there is no specific law or act that recognizes adult ADHD as a disability.

Impact:

 The lack of recognition of adult ADHD as a disability in India means that people with ADHD may not have access to the accommodations and support they need to succeed in the workplace and other areas of life. This can lead to significant employment challenges, as well as social stigma and discrimination.

  • Many adults with ADHD struggle with executive functioning skills, such as time management and organization, which can lead to difficulties in completing tasks and meeting deadlines. This can lead to negative consequences in the workplace, such as poor job performance or even job loss.
  • Adults with ADHD may struggle with maintaining attention during meetings or presentations, which can affect their ability to learn and contribute in the workplace.
  • Adults with ADHD may experience significant emotional and social challenges, such as difficulty maintaining relationships or managing emotions, which can affect their overall well-being and quality of life.
  • The lack of recognition of adult ADHD as a disability can lead to significant stigma and discrimination, with individuals with ADHD often being viewed as lazy or unmotivated.
  • Adults with ADHD may face barriers to accessing appropriate healthcare and support, including difficulty finding providers who are knowledgeable about adult ADHD and limited availability of support groups and resources.
  • Without recognition of adult ADHD as a disability, individuals with ADHD may not be eligible for accommodations such as extra time on tests, which can affect their ability to pursue higher education or professional certifications.

Action:

 We are asking the Government of India to officially recognize adult ADHD as a disability under the law, and to provide the necessary accommodations and support for adults with ADHD to achieve their full potential. This would include:

  • Providing accommodations in workplace settings, such as flexible schedules and the use of assistive technology
  • Ensuring that adults with ADHD are not discriminated against in hiring, promotion, or other employment practices.
  • Raising awareness of adult ADHD and related disabilities to reduce stigma and promote understanding.
  • Providing training and resources for healthcare professionals and employers to better support adults with ADHD

Medications and Therapy/Counselling:

ADHD can be treated through a combination of medications and therapy/counselling. However, access to these treatments can be limited for adults with ADHD in India. Medications such as stimulants can be effective in reducing symptoms of ADHD, but there may be limited availability of these medications or barriers to accessing them due to cost or availability.

Therapy or counselling can also be an important component of treating ADHD, as it can help individuals with ADHD develop coping skills and strategies to manage their symptoms. However, there may be limited availability of specialized therapy or counselling services for adults with ADHD in India.

Recognition of adult ADHD as a disability in India could help to increase access to these treatments for adults with ADHD, including by ensuring that medications are more widely available and affordable, and by increasing the availability of specialized therapy or counselling services for individuals with ADHD. This could help to improve the quality of life and well-being of adults with ADHD in India and enable them to better participate in the workplace and other aspects of society.
