Recognise under-16s in the legal definition of domestic abuse
The Issue
When I was between the ages of 14-15, i found myself trapped in an abusive relationship at the hands of someone i thought i could trust. Despite the many difficulties i faced for over a year, the legal system failed to serve me justice. The reason? I was not 16 years old when this abuse occurred, caught in a loophole that was supposed to protect me resulted in my abuser walking free. Despite the challenges i've had to face, i want to use my own personal experience to protect others in similar situations.
In the UK, domestic abuse laws focus on recognizing and protecting individuals aged 16 and above. This legal age restriction leaves those between the ages of 13 and 15 vulnerable and unprotected in abusive relationships. It's time we reevaluate this framework. The statistics are alarming – one in five teenagers is known to experience emotional, physical, or sexual abuse within their relationships. Yet, the system fails to offer them the justice and protection that older victims are entitled to.
Under current laws, adolescents like I once was lack the legal recognition that could ensure their safety, provide legal recourse, and significantly impact their future well-being. This oversight is not just a gap in policy but a failure in our fundamental duty to protect all children and young adults from harm.
The change needed is clear. We propose amending the Domestic Abuse Act to include individuals aged 13-15 in its definitions. This amendment would provide these young teenagers with access to legal protection measures such as restraining orders, access to safe spaces, and specialized support services. Moreover, it acknowledges their experiences, offering them a chance for justice and the healing process they deserve. This would also help to rehabilitate perpetrators to ensure they don't carry on this behaviour. This is crucial.
By including adolescents in domestic abuse legislation, we ensure our legal system provides equitable protection to all our young citizens, regardless of their age. It's about recognising their vulnerability, validating their experiences, and valuing their safety and well-being as a paramount priority.
