Clemency for Jeffrey Gardner

The Issue

In a situation fueled by scandal and greed, an innocent man was charged, convicted, and sentenced to 500 years in prison.

In the case of Jeffrey Gardner v. Commonwealth of Virginia (case numbers 01-597, 01-598, 01-599, 01-600, 01-601, 01-602, 01-603, 01-604, 01-605, & 01-606) arising out of Washington County, the facts of the case are simple, yet were detrimentally distorted and tainted with falsehoods for the sole purpose of ruining Mr. Gardner life.

 

Mr. Gardner, an honest man whom has served in the military with an honorable discharge in 1998, among other things, fell in love with a woman and instantly became submerged in a toxic relationship. Mary, the woman he fell in love with, had mental health issues and 3 preexisting children of which Mr. Gardner treated and considered as his own. Despite the many red flags that were noticed by Mr. Gardner, he looked passed them because he loved her and overall, he understood that nobody is perfect. They later got married and persisted forward as he continuously looked pass her reoccurring flaws. He understood his wife's mental health issues and encouraged her to take her medication while being as supportive of her as any reasonable man could be of his woman.

The marriage, just as countless other marriages, faced challenges of ups and downs as they struggled with burdensome financial problems. One day Mary discovered 2 individual life insurance policies for Mr. Gardner of which his mother and grandmother was listed as the beneficiaries. One of the policies was for $200,000.00, and the other was for $50,000.00. Mary became furious and demanded that she be made the sole beneficiary for both life insurance policies. Mr. Gardner explained to her that the policies were no good anymore but she relentlessly believed otherwise. He agreed to make the change so she could calm down and drop the issue (even though he knew they were no good anymore). All seemed well for several weeks until Mary and Mr. Gardner were at her parents cookout having some drinks. Unknown to Mr. Gardner, Mary and her sister were conspiring to poison him and collect the life insurance money upon his death. When their attempt to poison him failed with him becoming aware of the plot, he wanted nothing more to do with his wife and out of rage, she vowed to ruin his life. Feeling as though she had no direct angles to have Mr. Gardner incarcerated, she relied on an indirect angle. Mary decided to frame Mr. Gardner for sexual misconduct with her children. She influenced 2 of her children to make false claims against Mr. Gardner and informed them of what to say. She later made the official report to the Washington County department of Social Services accusing Mr. Gardner of molesting her children. Two days later an official report to the Washington County sheriff's department was made, of which was different and more detailed than the report to social services. Several months later Mr. Gardner was arrested and charged with 11 counts of sexual misconduct based offenses. Mr. Gardner was sentenced to 50 years for each of the 10 offenses (totaling 500 years) with 450 years suspended, leaving Mr. Gardner with 50 years to serve in prison.

At the initial trial ended with a hung jury. In the second trial, one of her children admitted that Mr. Gardner had never did anything to him and that his mother (Mary) and his grandmother told him what to say. Her other son was persistent with what he was told to say and it resulted in Mr. Gardner being convicted on 10 offenses. Despite the fact that one of Mary's sons confessed that he was told what to say and that Mr. Gardner never did anything to him, Mr. Gardner was only found not guilty on 1 out of the 11 counts of sexual misconduct.

We understand the severity of sexual misconduct based offenses and believe that no one should be subjected to such misconduct. We further believe in justice. Mr. Gardner is an innocent man that's being subjected to criminal convictions, an extremely long prison sentence, and defamation of character.
