Hello all voters/residents living around Lake Street, here are some updates on noise level complaints to Druk Zomsa including current actions taken by the council and what we can do next.

The noise are back on the weekends! Noise/crowds was seen until 2am-230am on Friday and Saturday!

  • Generally, we/residents around the area are ok with them to operate legally as a food business in indoor and to operate within their trading hours but NOT having loud activities at the upper outdoor balcony with karaoke/dance music.
  • Weekdays are generally fine with business closing around 10-1030pm and noise level are well-kept even they had patrons at the upper outdoor level. (see above monitor logs)
  • Thursday and Sunday varies depending on the crowd as there are days when the crowds are larger and they tends to stay past midnight - when the noise/conversations can be heard clearly.
  • Friday and Saturday - Almost every week, the indoor/outdoor activities are observed after midnight when the restaurant are closed and lights are off. Young patrons are visiting at 1am-2am - having loud conversations, smoking (can be smelled across nearby units during windy days) and probably drinking at the premises (unsure if they sells alcohol). Music are back at the outdoor platform. Last evening, dance tempo music can also be heard for a period of time.
  • Disco lights are back with more light decorations at the upper level. More patrons are seen smoking at the outdoor area and along the street on 100 Lake Street. Illegal parking including the owner's UTE can be seen parking at the no parking sign at most times.
  • Karaoke was moved indoor but no proper sound insulation was done. Crowds still gather at the outdoor balcony at times and music can still be heard.
  • At a few occasions, a couple of homeless will shouting around the area and was trying to challenge them with the loud music/noise.
  • As a resident living near to them - it creates lot of stress and anxiety as we do want to have a proper rest at night but there is not much we can do when the issue is happening. Also, we have babies, kids and elderly living around the area which caused a lot of inconvenience and noise disruption. (I, myself are expecting a newborn in 1 month time and this noise issue is giving me a lot of stress and discomfort)

Council (City of Perth)'s Actions:

  • Two to three weeks ago, a case was opened by City of Perth due to multiple complaints and a few Community Health Officer was in charge, including a recent case where a running generator was left overnight causing a constant flow of noise disruption for a day.
  • A sound detector device was placed for a week to gather noise data but it seems that the data is not very helpful as the business received warning ahead and they had a quiet week (2-8 August); and noise is starting to escalate back over the weeks.
  •  I called in early this week to make a further complaint about the situation and Community Health Officer has provided some updates. She mentioned that she was away for two weeks and had re-spoken to the owner - which he has NO IDEA about the noise disruption that they caused. (This is pretty common sense! Also, I did spotted the owner a few times at the upper balcony level after midnight in the dark setting)
  • Council Officer also mentioned that this issue has been brought to the 'Racing, Gaming, Liquor' Department to investigate as the business only had a 'restaurant license' to operate (which they can BYO but can't sell alcohol; and the primary business had to be food business with a chef and menu in place). However, the activities they had with the karaoke and in the dark setting past 2am should require a proper nightclub/club license which they current do not have.   • She also mentioned that the owner are intending to move their karaoke to underground setting (which was not confirm; however the thought of underground music may bring vibrations/tempo around the area - which I am hoping that it will not happens).
  • She was trying to tee up with other Urban/Building department to look into this issue but all seems invalid.

The noise and crowd are seriously back again this weekend! Next step, we as the residents around the area need to push forward with a firmer approach to the council to take action immediately - I strongly encourage one can help to call into to the authority (City of Perth: 0894613333 and mentioned '100 Lake Street Noise Complaints' CSR:513741 ) to make further complaints so that they feel the urgency to act - whether to issue a PROPER warning/fine to the premises and not just verbal warning so that the business can react duly. 

I, myself will call in on Monday again to check on further updates. At this stage, I want to push for ALL Druk Zomsa's activities to cease after midnight. I am more than happy for Druk Zomsa to continue their food business activities from the evening until 10/11pm on weekdays/weekends but NOT other activities after midnight that runs through 2am. If council do not actions further, I will bring this news/issue to ACA to investigate.

Hope this matter can be resolve and bring back the peace around the area.
