It's meant to help cover the losses and medical care required due to our injuries, both visible and invisible. However, current laws allow this essential income to be factored into divorce settlements to determine spousal support or child support, despite it being intended solely for the veteran's rehabilitation and welfare.
According to the U.S. Department of Veterans Affairs, there are over 4.9 million veterans receiving disability compensation as of 2023. Many of these veterans rely on their benefits for basic needs like housing, healthcare, and daily living necessities. By including VA disability pay in divorce calculations, the very support designed to aid veterans in rebuilding their lives is diminished.
The Veterans Benefit Act states that veterans' benefits are not to be considered as income for other purposes such as eligibility for non-veteran-specific programs. Despite this, loopholes in family law have allowed VA disability pay to be used against veterans in court, unfairly impacting their financial stability.
